No! He said is was scratched but still legit. He even took a photo to prove it (LOL). I was nice enough to send him a message telling him the card's useless. I wonder if he'll still sell it?

Well he does say that the photo may or many not the actual item he is selling.
He does have a ton of feedback so he should know better.
It could be that you will get a real code when you win and it will work just fine. Might even be a good deal as many bidders might not think they are bidding on a good code.
Ask the seller. See what he says.
