From a seller on Ebay after I won SMT Nocturne finally

Hey, I was going to cancel this auction this morning, but I was too late. My apologies to bring you bad news. I have the game. But it isn't in that great of condition. It's missing the manual, and the case is in cracked severely. And the disc, has one deep scratch. The rear insert also has some coffee damage. I'm sorry I couldn't get to cancel this auction in time. Last time I checked, this game was perfectly fine, but the kids must've messed around. I'd rather not sell you a defected item. If you wish to see pics of the actual item now, I will send them to you. Since this is my fault, you don't have to be commited to buy it.

Did you get a really good price on it? Shady sellers will sometimes do this when an auction doesn't meet their expectations. I got a very similar email two weeks ago when I won a rare football jersey for basically nothing. Check to see if they re-list it in the future.

Did you get a really good price on it? Shady sellers will sometimes do this when an auction doesn't meet their expectations. I got a very similar email two weeks ago when I won a rare football jersey for basically nothing. Check to see if they re-list it in the future.

I've gotten the EXACT type of email from game sellers when I got "complete" games, or new sealed games at the maiden bid. (In almost every case $10.00 or less starting bid.)

In some cases they've even refunded my immediate PayPal purchases, then filed an "incomplete" transaction with eBay - who will contact the buyer (me) with a feedback form that pretty much won't let you say anything other than "Did the seller take your money and send you anything - YES / NO".

This is so he won't have to pay for the "2% selling fee".

This seems to be a growing problem on eBay ... sellers unhappy with the low selling price just send an email explaining some type of "problem" and re-list the item at a later date.

In most cases, if they can re-coup a higher sale price, it'll net them more money even with the listing fees.

Awful crap really.

Wow, that does sound like a nasty scam. The buyer can't leave a neg and have ebay action brought against the seller in this case? The contract is complete, the offer, acceptance and payment have all happened, the seller should be held accountable. We all know the sellers would be remiss to neglect to file a non-paying bidder report should the reverse happen, so why shouldn't the seller be held to the same standard?

Possible scenario little kid knocks coffee cup onto manual and then case is knocked to the ground, disc not put in properly skids across the floor ruining it. Family pet comes by and smells coffee and decides to chew case

Sure, I could file counter-claims against the seller(s) ...

... and in every case I did leave negative feedback.

However -

A.) These sellers are usually bulk new/used game sellers that already have a higher than normal percentage of negatives which are kind of hard to sift through to find things more specific than "the game was really dirty".

B.) In every one of these cases involving PayPal payment the seller IMMEDIATELY provides a full refund via PayPal including shipping costs ... and eBay, regardless of contractual obligation will not help pursue damages above and beyond that ... and honestly, what further damages could one claim other than being disappointed?

It sucks, but it's a loophole that I hope eBay finds and somehow fixes in the future.

Btw I checked his feedback and he had no negs but a few neutrals. I'll wait for him send pics but i won another copy anyways

I had a similar experience, the kicker was some time after I got the immediate paypal refund, they filed a non-paying buyer claim. They never followed up on it and it expired. I had also found the item w/ the identical description sold under a different username.
