View Full Version : Am I being unreasonable here?

So almost a month ago now, I ordered a collectible PC game from an Ebay seller for $40. This seller sells lots of collectible PC games and posted a picture of the original release packaging and confirmed in the description that it was the original retail box version. I immediately paid with Paypal and even paid the $10 shipping charge, despite the fact that the game was going to be shipped by Priority Mail and only cost the seller $5.25 to ship with tracking. Anyway, a week later the game arrives and it turns out the seller sent me one of those cheap DVD case re-releases that they sell at Fry's and other places for $10. I e-mailed and the seller claimed that he sent me this version because it was "more compatible" with newer computers. I responded that I didn't want a newer version and that if I did, I could have gone to the local Fry's and picked it up. After several e-mail exchanges, he agreed to replace the game but I would have to ship it back unopened and pay for the shipping. While I don't think this was fair, I went ahead and did it.

Yesterday, after three weeks of waiting, I e-mailed the seller and he denied receiving the game. I checked the tracking number and confirmed it had been delivered two weeks ago. He then changed his story and claimed he got a package from me, but it didn't have a game in it, rather it had another gift item and a note. This sounded shady to me, but he provided pictures and what I can gather is that the package was damaged in transit and the USPS put another item in the box figuring it was the right one. They didn't attach a notice, but he sent me pictures and it looks like they put plastic straps around the priority mail box I returned the game in.

So, long story short, the seller is now refusing to refund my money or replace the game. Am I being unreasonable to expect a replacement given that it was his mistake and I shouldn't have been responsible to ship the original game back initially? I really am curious about what everyone thinks.

Sounds like bullshit to me. For a start he should not have changed the item AFTER the auction ended and second that entire story about a different item been in the packaging sounds VERY suss.

Did you pay with PayPal? You might be able to open a dispute, otherwise there is not much else you can do. Just hit him with a negative I guess.

I agree. If you used paypal, open a dispute and give all the facts you can. I don't know how they'll handle the return issues you had, but clearly you didn't receive the item as described.

I'm not sure PayPal would agree that this warrants an arbitration in your favor. I mean, you can try...

I agree with your grief, for what it's worth. His description said original packaging, and the way he changed his story later was BS.

Sounds like BS on the sellers part... If he doesn't make it right, I'd leave negative feedback... but I'd warn him first. That is unless he threatens to leave you negative feedback... if that's the case, I'd go the paypal dispute route. Even if may be a long shot I'd try anyway.

A couple years back I sold a fellow DP'er some old VG magazines. I sent them media mail, so I expected them to take a while to get there. Once they did, he emailed me and asked where all the rest of the magazines were. Apparently USPS had busted the box open, lost more than half of the magazines, then put the ones that they found into another box, taped it up and sent it on its way. After hearing about what happened, I refunded half of the $ to the buyer just because it seemed like the right thing to do. But in your case, it smells a lil' fishy

Don't do this. Leave the appropriate feedback after the transaction is over, not in the middle, especially not immediately after you begin a dispute. Feedback is the final step of the transaction, and as a seller, when a moron buyer leaves me a neg, I instantly stop trying to rectify the situation until it is removed.
