It seems Gibson has gone lawsuit crazy, as of late.

The thing I always wonder about these frivolous lawsuits: why don't they ever pop up earlier? They always wait until the supposed patent-infringing item is a smash hit before they take action. To make matters worse, in this case Gibson collaborated with Activision to license their guitar designs for previous games.

There's another company to add to the list of brands whose products I wouldn't even use to wipe my ass.

Right on. Not that I needed another reason to never buy another Gibson product, though. Their quality control is horrible, they now put out for the most part sub-par, overhyped and overpriced products, and I believe they've also recently taken to strongarming dealers into not revealing actual prices online -- presumably to add to the mystical unattainability and real-ultimate-power pretense of Gibson products to Guitar Center garage kiddies and the generally uninformed.

My favorite local guitar shop (http://elderly.com/) doesn't even carry new Gibsons anymore.

In addition to this, a few months ago I read a nightmare scenario on Consumerist where Gibson gave a "Battle of the Bands" winner (who was supposed to win a $10k prize package) a runaround for about a year and I still don't think he ever received what he was supposed to. The contestant was into hip-hop and thus didn't need guitars and such so he tried to get other things and Gibson kept on adding exclusions to what he could pick and (reiterating what you've said) gave him list prices that were much, much higher than what music retailers were selling them at.

Anyone notice that on the back of Guitar Hero 3 and maybe others. That is looks like Gibson was one of the sponsors of Guitar Hero 3? It looks like it reads that Gibson and Activision may of had a license together if I read it the right way.

This is actually a great point. They always wait for it to become a smash hit because then their damages claim is bigger.
