this NIB NES deluxe set really strikes my interest, but i have 2 questions:

1. is there any way to confirm that it is indeed new-in-box?

2. how much would you pay for it?

I think some close up pics of the game boxes would tell if they've been opened or not. That might be a clue to whether it is truly unused or not. There should be some paper warning things on the gyros that would probably have been removed if it is used. I think that price is not out of line if it is truly unused. I sold an earlier version that did not say "deluxe set" on it last year for $350. The contents were used but very nice with most of the paperwork, no plastic bags and the box had some damage. I certainly wouldn't buy it for $500 expecting to flip it for a profit anytime soon but if you want it for a permanent collection you may not find another in the near future that is that nice.

There are paper circles that have some sort of warning that go on top of each gyro. I can't remember what they say. That Action Set certainly looks like those bags have been wadded up and re-used.

I have two brand new never used Deluxe sets that I have taken pictures of. The pictures are on another computer so I will have to grab them off of there before I can post them.
I will post what the gyro's are supposed to look like.
It's a little hard to tell in the auction, but it looks like a piece of the styophoam is broken off. It's in an area where the styrophoam always seems to break off too.
Also, as the OP said, the plastic bags do appear to be wrinkled which is a tell-tale sign that the system HAS been used.

Sadly, some people do not realize that if something has been taken out of the box that it is not NEW. Mint/Like new/perfect shape is one thing.
