So I bought a copy of Lucienne's Quest on eBay. It was a terrible idea in the first place, in fact, I'm having to sell off some of my stuff to make up for that impulsive decision, but whatever.
The description is, verbatim:
VERY RARE 3DO Game !!!!!!!!! LUCIENNE,S QUEST With Instructions !!!!!!!
Game and Instructions in Very Good condition !!!!!!!!!!!

I finally receive the game, and it's in a fucking CD-R case!

I e-mailed the seller and he replies:
"You got what was listed Game with instructions I cant belive you would complain the case."
It's a $100 game, and barely that even if it did have the back insert! I know he didn't explicitly say the back insert was included, but nobody does, isn't that just assumed? Especially since it was in the picture. Am I in the wrong here? I'm sorry, I know there are a lot of honest sellers here, but I am so glad he can't leave me a retaliatory neg anymore.

I'm not saying this guy isn't a scum bag, but I can't believe you would spend anything more than a few dollars without asking for additional pictures of the case and disc. Having said that, the photo pretty clearly shows the Panasonic Interactive Media inlay, so if that's not under that new CD-R tray insert he included, you have a very legit claim.

Yeah, it was impulsive. What can I say? It was actually a "best offer" that I didn't expect to stick, but at any rate, I worried it would be gone before I could get more information on it.

The bottom pic is the complete (w/o outer box) one, which was the auction picture. The top pictures are the front and back of what I got.
I did ask for a refund, but the guy is making it sound like it's no big deal. Looks like I'm headed towards a dispute...

Yeah, pretty much this. It doesn't matter if you paid $5 or $500 for the game, it didn't arrive as described/pictured. Looks like he stole the image from another seller.

Unless you buy 3DO games, you'll probably never run across him, but his username is Cin4.
Also, thanks to everyone who replied. Only a collector can understand that a case and insert are a big deal. The guy made me feel like I was crazy anal for wanting everything like it was in the picture. He's agreed to a partial refund, which works for me. Took a lot of arm twisting though...I don't understand why some sellers are so "BRING IT ON" when it comes to Paypal disputes...it's so hard for them to win, even in cases when it's not this cut and dried.

Look at the right side of the manual in the first picture. It seems fine. However, the version you got has a small tear / wear there. (Heh.) So it WAS a stolen picture.
What a douchebag. :\
You should've filed a claim for a full refund just to spite him.
