Considering that Zophar hosts a bevy of soundtracks, and SNESmusic.org is still up after years, I'd say the evidence points that way.

It's not. The files are still being distributed without the permission of the parent company -or- the composer.

Right now, Sega is so eager to please their fans, they don't care what anyone does. Sprite recolor characters, piracy, they don't care. They need all the Sonic customers they can get these days and won't risk making 1 single person mad with legal action.
