I don't own an Xbox 360, but I can tell you one thing that I know for sure: if this console has been banned from XBL, nothing you can do will get its banishment removed outside of calling Microsoft and convincing them to give a pardon to it. (That result is quite unlikely by the way.) You see, each Xbox has a unique "serial" number embedded in its hardware. This number is used as an identifier for all sorts of things including to identify it to Xbox Live. And if their database says that this one's number is banned, you won't be able to take it online no matter what it does or does not have installed upon it.
Have you tried checking out the burnt disc on your Xbox or PC to see what it is?

Worse case senerio you use it offline as a single player decive. Can't complain as it was free.

If it's an older soft mod I know you can wipe it out with a firmware update because I've accidentally updated mine and lost my ability to play bootlegs.
What I don't know however is if updating the firmware and wiping out the mod even matters, the mod itself might leave some digital fingerprint which microsoft can still pick up and ban your account anyway, leaving you with an offline machine that can't even play burnt games anymore

If it is modded and you can't get it back to normal mode you have one hell of a emulation machine.

It learned that in the circus. *ba-dum-dum-tsssh!*

So I deleted everything off of the machine manually by just clicking through the menus and deleting (demos, avatars, game saves, login users, etc.) After clicking through everything I don't see anything in the menus anywhere that suggest any kind of custom firmware or OS. Something has definitely been done to the machine b/c it can in fact play burned games - the disc in the drive when I found it was some NFL '11 whatever game (not a sports game guy here :)) and it plays just like a normal game. This machine IS banned from XBL, and while that's too bad, the only thing I was interested in buying digitally was REZ HD, and I can live without that I guess and I could care less about playing any Xbox games online at the moment. If this is an offline single player machine (for free) then I'm fine with that, perfectly fine.
I guess what I'm still trying to figure out is - how does this machine know how to play burned games? Is it a soft or hard mod and what identifiers can I look for to indicate either of those?
Rez HD is available on the Qubed game collection disc along with Every Extend Extra Extreme and Lumines Live! It should be had for as little as five dollars.
