Once again they just don't get it. We pay high prices beacause it's SEALED, not maybe new if you say so.

That seller always bugged me for some reason... most of his auctions linked to other auctions that had ended at around the same price he listed his for...

I am getting tired of this myself. Recently I have become a victim myself, but, maybe I am partly to blame. I won this auction a few days ago...

Now granted there is no picture of the item, but it does say its "NEW" and "Factory Sealed." So I figured there's not much risk at $3.99.

I received the item today and of course its not factory sealed. The shrink wrap had ben opened on top. Not only that but the instructions, warranty card and controller overlay (if any) were all missing. So I email the seller:

"Hello,

I got the game today and I am very disappointed. The auction clearly states the item is "New" and "Factory Sealed." It was neither! It is opened, the instruction manual, controller overlay and warranty card are all missing. Moreover the box is dirty. I want to send it back and get a refund, including my shipping."

The seller responds saying I can go ahead and send it back (no word about whether a full refund will be issued), but he states:

"You can send it back if you want but the game is new."

Umm, excuse me, but how is "opened with missing documentation" considered to be "new and factory sealed"? He blatantly lied in his auction. I am not going to reply to his comment as I just want to get my money back, granted it is only $9 with shipping.

$5 Shipping is a rip off and you're also out the cost to ship the item back to him. x_x

$5.00 isn't bad when you consider it was mailed Priority Mail ($3.85). I have no problem adding on a $1 handling fee. Now if he would've mailed it media mail, that would've been a different question.

If he added delivery confirmation , the profit is down to $.65 :-P
