Ok i bidded on an item and some stupid idiot outbidded me at the very last minute when i was going to win it...sigh...anyways, i emailed the seller like about a week ago and asked him some questions about the item, asked him how many of those he had, and told me he had plenty of them...is it ok if i email him back and ask him if he still has anymore items to spare so i can buy it?? or is it against the e-bay rules? :eek 2:

Don't see why it should be against eBay's rules your enquiring to buy an item that the seller hasn't put on eBay reguardless of if they've sold any on there in the past or not. It's not like your trying to offer the seller something to give the lost auction to you, your asking if they have any spares left to sell.

I agree. If it hasn't been posted to ebay yet online yet then its just a transaction between two people and eBay has nothing to do with it. On the other hand, if the guy screws you then you'll get no assistance from ebay either.
I wonder if you'd even get protection by Paypal. If the item was never listed then who can say if it wasn't as described or not/

true, that's why i'm wondering if i should do this, i emailed him, and he responded, said he was willing to work something out with him and how much i'm willing to pay...i mean should i offer him the same price from the auction? well...i don't have paypal, so i always pay my winnings with money order, much safer?

Well, I have done the same thing, I bid on a complete UK copy of Biomotor Unitron for the NGPC and I got outbid at the last second. The guy e-mailed me, saying he had another one, and for how much the other one went for, he'd sell me the other for too. So, I said, what the heck, accepted, and sent money by paypal. The guy kept his word, sent, and I got the game about a week later. Unfortunately, it was not on eBay so I didn't get any feedback or anything for it.

It's not against E-Bay rules to e-mail him and try to work out something.
But rule #1 is : ALWAYS OFFER LESS !!!!!!
Don't offer him the max bid.

Ive bought things a couple times outside of ebay. Ebay says its against their rules but just send the emails outside of ebay.

No Ebay does NOT say it's against their rules. In fact they say that it is acceptable.
In a previous thread I posted the link to Ebays own policies which says that after an auction ends you can e-mail the seller and buy his item if a. it does not sell or b. He has more items for sale.
And then they go on to say it is fine but you won't be covered by Ebays fraud policies.

I've done it a few times and it's worked out. Homer's right, offer less. In fact it will cost the seller less because there's no fees and such.

Remember that buying an item from a seller outside of an eBay transaction is risky. These transactions are not covered by the protections that eBay offers, such as buyer protection, dispute resolution, mediation and Feedback. It’s also against eBay rules to ask a seller to sell you an item outside of a listing.
Ok. So if somebody lists something, you may buy it without going through the ebay stuff. But you jsut cant ask a seller to sell you something through the ebay email thing unless they have it listed. 8-)

Ok I think you're trying to make this harder than it is.
I am an Ebay Power Seller with a 24/7 1-800 # for Ebay support and I've called and asked about this.
If someone has something listed and you ask them to END the auction and sell it to you. They can report you and you will be warned and if you do it again , suspended.
If the auction is active you can not e-mail the seller asking if he has more that he can sell outside of Ebay.
If you ask the seller to put a BIN or sell to you at the current price if you are the high bidder, that is fine.
If after the auction ends you can do all of the following without it being against Ebay Policy:
1. Ask the seller if he has more of the same items for sale , and would he sell them to you.
2.Ask the seller if the deal falls through would he sell to you.
3.Ask the seller if he has ANYTHING else he would like to sell.
And in all of the above cases you can use the "Ask the seller a question" form.

Seriously? you can get suspended for asking if they'd end it? Oh crap! I've dona that many times, and fortunetely I haven't gotten any warnings. Now I'll know not to do that from now on...

Only if they report you. And only if you ask them to end it and then sell it to you outside of Ebay.
You can ask them to let you become the high bidder and the end it with the "Seller ended early to sell to the high bidder at current price" option (or whatever the option is called thats about the same wording).
Or get them to add a BIN at the price you agree on.
