Bite the bullet. You sent her and item without recieving payment. Ebay is definately not the place to test out the "good faith" theory, especially with such low feedback.

People who don't know anything about games or casual gamers do buy videogames on eBay, so it's something you need to state upfront wether it's Japanese, European, US, etc. If I knew nothing about games and was looking for some "Sonic game for Dreamcast" just looking at your auction I would have no idea that it wouldn't play on my system.

If anything, she just scammed you by getting a free game.

And what did we learn from this little adventure?

1, when selling imports, it is a good idea to mention that they won't work on US consoles in your auction.

2, when selling on eBay, it is a good idea to collect money before sending goods.

Now, if it were me, I would call them every single day, leaving messages, calling during the day, the middle of the night, and several times a day until I either got paid or got the money back.

1. Collect the cash first!
2. Repeat #1
3. Chastise self and flagellate self with medeival torture device repeating "I will ship no goods before it is time" :eek 2:
4. It's only 25 bucks... laugh and chalk it up as a learning experience. It's not worth getting that worked up about.

Next time, send it to me instead. I wouldn't mind having a spare. I paid full price for mine the day that it was released, and I've seen them being sold at some import shops for as little as $10 now, so I think I deserve a free copy!

I agree - I think it all went wrong when the goods were sent before payment was received.

Awfully nice of you to do that, but you're just grabbing your ankles with a tube of lube laying on your back asking for it when you sent the item first.

You can keep on calling Darleen and maybe get her to send the game back, but i think it's best to call this one a loss.

I would call every day as suggested in this thread. Don't be rude or use profanity, just keep your temper in check and be that anoying person who calls every day and used up the whole answering machine tape.

Remember the paperboy from Better Off Dead? Following John Cusac around yelling "I want my two dollars". Do the same thing exdept for with the phone. :P

I totally agree with number 1.

And I bet you will not send the goods first anymore :o

i was going to ask her to send it back but she said her kid already opened it and probably scratched the hell out of it. i never once used profanity, and she repeatedly used the 'f' word. and to make things worst, her deadbeat husband jumped in and said, "hey, sue me for the 30 bucks." what a bunch of losers.

Geez, their attitude makes you want to go to the trouble of suing them for $30.

If you still have time, take solice in leaving her a scathing negative feedback and wash your hands of her.

the bankruptcy is probably a lie, people always seem to have those types of excuses when they don't come through, however, if they are really going through bankruptcy, it's public record and you could file as a creditor and "get in line" to get paid. Not worth it for $30, but might be fun. At least you could tell them this in an effort to call their bluff...

Of all states to go bankrupt in! Texas is better to do that in.

Sorry to say but beyond phone calls, there doenst look to be much else you can do. Kids opened it? I doubt it. Unless it was the "kid" who bought it.

Yeah, Texas is awesome to go bankrupt in. The worst that can happen to you is a creditor can file for a judgement against you and get that granted before you file bankruptcy and get it finalized, but even then you never have to pay anything, it's just on record that you owe if you ever get any money.

I still have a $5000 judgement against me for an unpaid Mastercard bill, but never filed for bankruptcy and never heard another word about that bill after the judgement was granted. The best thing about it was they had to stop harassing me to pay it after the judgement was granted, so it was actually a blessing because they harassed me for it all the time before that happened.

So it's like I got $5000 in free money and never had to pay it back and never will have to pay it back. Technically, they can still try to collect it, but they can't garnishee my wages in Texas either, so there's really no way that they can ever collect it unless I decide to be nice and finally pay it back someday!

You gotta love Texas for that. My credit is completely shot to heck, so I'll never get an unsecured credit card again until I pay that off and all the other old cards that I still owe on, but beyond that I still basically got free money.

I'd still ask for it back to play it myself.
