OK, I'm sorry, but when I'm playing a game, I don't WANT other people to hear me. I have kids, sometimes at night I'll drink, I have music playing, if I die, I'll swear. People don't need to hear that, and I would probably get banned for it.
Not that I ever plan on getting an xbox, just my $2

There's a mute button and volume control.

As Anotherfluke mentioned, there is a mute button. Not only that, you don't need to have the communicator plugged in at all and in most games the other people playing are able to tell that you don't have voice on so they won't bother trying to talk to you.
For me, this is what MAKES XBox Live. It's been really cool hooking up with people (especially users of this board) and chatting them up while blowing them away. Or in my case getting blown away. Don't knock it until you try it.
