Anyone know if you can use any old headset with Xbox Live or do you have to use a Microsoft Xbox one? The one that comes with the starter kit sucks and it hurts my ears.

You can use aftermarket ones :) I use the same one that plugs into my phone :D And yes the xbox one hurts my ears too.

The one I had that came with the UT2004 DVD LE, didn't work.

I broke my official M$xbOX headset, and they still cost $30 at Gamestop/EB; so I bought the $5 cheapo MadCatz headset, which has worked just fine for me.
