Well, at least a POSSIBLE Rarity Alert, I was reading this over at CheapAssGamer, The story is by David Jenkins of Gamasutra.


A seventeen year old girl is suing Topheavy Studios, Gathering of Developers, Microsoft and Sony over her topless appearance in the controversial console game The Guy Game.

The unnamed teenager was photographed topless during spring break at South Padre Island in Mississippi, and claims that she was under eighteen at the time, which not only raises a serious question over the basic legality of the game, but but makes invalid any consent she may have given at the time.

A judge at Travis county district court has granted a temporary restraining order prohibiting the sale of both the PlayStation 2 and Xbox versions of the game, which use the girl’s image, voice and name.

According to the lawsuit, the plaintiff has suffered humiliation, embarrassment and shame since the game has been released. According to the Cox News Service, the lawsuit explains: "Plaintiff is still a teenager and wishes to attend college, develop her career and be active in her community and church." However it is not clear what, if any damages, the lawsuit is seeking from the four companies.

The Austin, Texas based Topheavy Studios is headed by Jeff Spangenberg, who has a more illustrious career as the founder of Turok developers Iguana and Metroid Prime creators Retro Studios.

I'm having a strong urge to run out and find this game, because if this IS true, you know all the current copies are getting destroyed.

I love the part where it says she'd still like to be active in her church. Sorry, girly, but I don't think God ever said it was okay to get drunk, make an idiot out of yourself, and flop your tits around a huge audience before you're even out of high school (not that it's cool to do that even when you are of legal age). What the hell were her parents doing? Did they honestly agree to letting their 17-year-old daughter run off on spring break by herself? Don't they watch TV? Everybody knows what goes on at those spring break places.

If she "suffered humiliation, embarrassment and shame", good, that's exacty how you're supposed to feel about doing that crap, whether it gets filmed or not.

I agree with your 100%, I DON'T care to play this game, but as a PS2 collector I'm up for anything possibly hard to find in the future.

Now, I'm having a hard time that believing that she was really humiliated, embarassed and shamed over this as well, I honestly believe she was probably telling all her friends about it until one of her friends who wasn't stoned off his ass said "you know you can sue them cause you're only 17". THEN all of a sudden, it's a huge travesty.

People like this really do make me sick, but yeah, good church girls DON'T go out partying like this during Spring Break.

Under Federal Law, there is no case for Child Pornography though.

Just to clarify that before it becomes a hot issue. Sexual Situations, Touching of Genitalia, or inside of a Vagina must be displayed to constitute an illegal action.

Of course, it's the guy game, and spring break, so I do assume there is some sexual innnuendo or situation involved. I haven't played.

Well, Kakuto Chojin was out for quite a while before being destroyed.

Thing about this one though, it deals with Child Pornography basically, not only would they destroy all copies, but I believe there would be something such as a money back deal or an incentive to get all owners of the game to fork it over.

Child Pornography and Muslim Chants are two different things

That's just rich. What I'd like to know is:

* Did the girl just decide on her own to sue Topheavy? If she was so against being shown topless in a video game (17 years old or not), why she do it in the first place? Also if its an embarrassment, why draw attention by suing? SOMEBODY'S gonna find out and it's going to get around. Plus if she was drunk at the time of agreeing to do the gig, why let people know you were illegally drinking? I'm thinking her parents found out (maybe cousin Bob got the game and said "Hey! That's cousin Jenny! She's HAWT!") and decided to push the issue.

* What takes place when signing consent forms? In something that contains such touchy images as nudity (no pun intended), would a proof of age be necessary (license, ID, etc.)? If it's just a signature next to "Yes I am over 18 and you have your permission to show me naked" on a form that's required, how would the developers know she really wasn't 18? If they do require ID, would that mean she was using a fake ID (as it would have been obvious that she wasn't 18)? How would that affect the lawsuit?

Another thought bouncing around my head along with the "parents might be making her sue" idea is that maybe she planned this. Sick joke to play during spring break with some friends with possible cash rewards. Think of it: she decided to do it in the "excitement of the moment" and now feels "exploited" even though she gave her consent ("How could I have known, I wasn't an adult...").

IF Topheavy did all they could for age verification (whatever is permissible by law for this situation) then there's a distinct possiblity this may blow up in the girl's face. Falsifying records (her ID), possible consumption of intoxicants while underage, possible fraud (not sure if signing a consent form pretending to be over 18 would constitude fraud) tacked onto showing your ta-tas to a bunch of strangers for a video game does a WORLD of good for your reputation for "school and church" :roll:

Maybe she saw that the initials of the developer spelled GoD and she saw a message in there, as the "good church girl" she is? (I apologize to any religious member of this board for my sarcasm, but I've known the real "church girl" type, back when I was in college, and flashing their boobs in public was not part of their lifestyle.)

It's funny how people equate nudity with pornography. And, of course, no one would give a shit about the game in question if society doesn't stigmatize females for exposing their chests.

Let's suppose that this piece of shit game does become a rarity as a result of the lawsuit. Cashing in on the game's rare value makes you a criminal since, in the eyes of the law, you are in posession of child pornography. In effect, your posession of The Guy Game is no more legitimate than posession of the videos Traci Lords made when she was underage. If you try selling that shit at auctions, you're at risk of being busted for posession and distribution of child porn.

Don't ask me how gawking at an 18 year old female is somehow any more acceptable than gawking at a 17 year old female.

I would like to show you a clear example of "thread jacking". The topic WAS "The Guy Game" and the possible moral infringments the game is up against.

At the juncture above, the topic was "thread jacked" and immediately became a discussion on Texas (Raedon was making a point about the legal age prior to this one).

Add to this the fact that this member is a notorious "+1 poster" and you've got all the elements of a decent thread gone bad. As you'll see, it quickly degenerated, thanks to another poster who didn't so much "thread jack" as he did "shit on the thread".

It will only get worse from here. Please use this thread as an example of how things should not be done. To those of you who positively contributed here, my apologies.
