View Full Version : So, The Guy Game finally got yanked?

I checked my email this morning and got the following message from GameTZ:
Your Games listing "Guy Game, The / Xbox" has been flagged "Fix-Me". Here is the reason:
A judge has prohibited sales of "The Guy Game" because it contains images of a naked underage girl. Thus, we are removing the game from GameTZ listings as well.
Please respond to this email within seven days. If after seven days the
listing has not been edited or approved, it will be automatically deleted by
the system. Any unapproved listing may be resubmitted if a link to a
web-shot or a scanned cover is provided. You have 7 days to edit this
listing and correct the problem.
Thank You.
I knew the girl in question was filling a suit against the people that made The Guy Game, but I didn't know that they made a ruling on it yet. I can't find any info online about it being yanked either. Did GameTZ make this story up and is just playing it safe, or did a judge really prohibit sales of the game?

Dude. The Judge outlawed sale of the game until there IS a ruling. This is really, um....old news when compared to the speed of the internet, and there is already a thread on this topic. The only reason I'm +1'ing it is to let you know that the Judge hasn't ruled on it yet, just told game distributors and resellers to stop selling the game in case it is deemed unlawful to do so.

Yeah, it's called an injunction. It doesn't mean that the girl will win her lawsuit, however.

But I had a used copy of The Guy Game for the XBox in my hands at my local EB on Monday!
How come THEY are still selling the game?
And did we ever decide what to do with this game? Is it going to become rare or should we wait until there actually is a recall? At $45, I passed up the game, but I'd like to snag a copy if they actually get recalled.

Jesus christ, I'm fucking sorry for asking the question. I did read the old post and I thought that the game was just yanked in Texas and not nation-wide, which was why I was surprised when I got the email from GameTZ. Regardless, thank you gracing my idiotic post with your illustrious presence. Dude.

ok, Just to recap so everyone knows.
The Guy Game supossably unknowingly had nudie pics of a 17 year old girl. The 17 girl is now sueing the makers of the game. Since she was 17, hense illigeal, The judge in the case has put an injunction on the game until they can verify that the girl was in fact 17 and didn't give her permission to be in the game. Thus right now it is technically illiegal to sell the game. Now, from my searching I have found that Game stop has recalled all there copies new or used of the game(I.E pulled it from the selves). I have also found that EB as of a few days ago had not pulled it.
Now, If the girl wins her suit the Guy Game is gone for good, and will forever be illiegal, If she loses the judge may lift the injunction and the Guy Game will be available whereever someone will carry it. Who knows if Game stop will restock it after the court case. Right now i'm surprised that EB hasn't pulled it since there is a court order to stop selling it.
Anyway hope this clears things up about this game.

Actually, as stated before, seeing a minor nude is not illegal. It's NOT illegal to show a minor nude in movies, games, etc. But when they are comitting sexual acts, that's when it becomes illegal.
And as mentioned before, the movie "Pretty Baby" is still in circulation, and it has a good bit of a nude 12 year old Brooke Shields in it.

Although I haven't read the complaint or her allegations, there may be other reasons why it could be yanked besides the child pornagraphy issue which everyone seems to be focusing on.
As a minor, she cannot be contractually bound to any contract, release, etc. Thus, even if she may have signed a release at the time of the filming of her exploits, she can "void" the contract/release at a later date, up to 1 year after turning the age of majority (probably 18 here). So I am guessing the game developers either didn't have a release from her, or secured a release from her which she later changed her mind (probably after someone recognized her in the game) and revoked the release. I think this is the more likely reason for the lawsuit. If it was an issue of child pornography, the authorities would be involved and bringing criminal charges, not the alleged "victim" bringing a civil action for money damages and/or injunctive relief.

The real question is did she lie about being 18 if/when they filmed this stuff for the game?
Suppose she did claim to be 18, would that not make her the "bad guy" since she knowingly claimed to be an age she is not?

No. The producers of the Guy Game would be at fault for not requiring identification. Even if she had a fake ID, they'd still be screwed. They could have easily verified the information obtained with the state. I know it all sounds crazy, but that's the nature of the business when you decide to film nude woman and market the item to the public. Moreover, it looks like this was filmed at a spot where it is known that high school/college girls go for sping break. They obviously weren't thinking that some of these girls were not of the age of majority, and now it has come back to bite them.

Well, I STILL wonder if I shoudl go snag that copy at my local EB before it gets pulled from their shelves.....
I guess it allready depends on what happens with the court case.
What do the collectors here think? Snag the game now and take your chances or wait and see what happens with the lawsuit? Either way there is some risk. I'm not a collector, but even I'm interested in grabbing this if it become yanked as it could be worth big money someday.

A friend of mine recently explained this same thing to me. Basically, parental consent is required. I believe what's her name...MJ from Spiderman (I think) had a movie where there was a big nude scene of her and her mom got really upset about it and wouldn't let her do it, as much as she wanted to (artistic integrity and all, blah blah). At least that's the way I heard it.

I wouldn't pay one cent for it new (and I don't think I'd get it otherwise); I would feel vindicated if this was a commercial failure. Farther we keep pr0n and the games seperated the better, right? :p

As of this evening they were still selling The Guy Game in my local EBWorld.
I picked this game up on eBay a little while after it was released. While it isn't great game it isn't as horrible as people make it out to be. There's a TV game show on at night that's almost the exact same game (minus the nudity). To me it seems that the big issue is that some people here can't handle seeing boobies :D
The game that WAS just pulled though (according to my local EBWorld) was World of Warcraft. Apparantly Blizzard just can't handle the server requirements that this game demands and is pulling the game off of store shelves until March when they hope to have enough servers in place to handle the demand.
Have you seen what this game was selling for on eBay?

Well, I'll be back in my local EB on Wed night to pick up my pre-orders on Zelda: Manish Cap and Suikoden 4. If they still have The Guy Game, I'll seriously think about it. I think I saw the sticker wrong and the game was $35 or something.
I'm not surprised to hear that about World of Warcraft, but some of my friends who play the game are going to have mixed feelings about it. No new people coming in for a while, which means their friends are out for now also. I hear that game (along with City of Heros) are the best MMORPG's right now, although I still play and enjoy FF XI.

Circuit City had World of Warcraft on sale this week for $39.99. I was there to pick up LOTR Battle for Middle Earth (also $39.99). I guess I should have picked one up.

I find B-games (Hentai games), dating sims, and idol games to be way more tasteful them some girls gone wild game. Which reminds me, I'm suprised as hell they didn't release Girls Gone Wild: The Game yet.

Yes? The markets are nothing alike. I don't buy Japanese H-games or spend time with them (I haven't even touched a Princess Maker game), but I don't say I want the softcore (Man Game sounds VERY softcore...saggy too?)/games connection to fail because I've got some illusion about being hardcore righteous. I simply don't want it to work out because at some level the idea of putting porn games on modern consoles is repulsive. Calling a traditional Japanese H-game "porn" works out, I suppose, but you consider that much of the time there aren't any real photographs, just drawn art (Qix clones aside....Perestroika Girls eeeeww). Maybe I'm being a snob for not wanting underage girls doing flighty things in my games, I don't know. LOL

You're forgetting what this game really IS -- mix one part quiz show, mix one part Jay Leno's 'stupid people', add a pinch of Girls Gone Wild, and mix well. :)
From everything I've heard and comments from some of our own DP members, it's a okay single player game but really shines as a party game. The breasts are just incentive to play the game.
And I agree -- I don't see it as being any worse then some of the new and very good hentai games that I buy, or the translated dating sims that I play. As a matter of fact, it's rather soft. I'm sure the Europeans are laughing their asses of at us over this. :/

The Sega Saturn had The Yakyuuken Special, FMV girls dancing showing off their tops. It also had Virtua Photostudio, which had you playing a photographer taking photos of of FMV girls, get far enough and they'll start removing their tops.
For PC, Sexy Beach 2 or whatever uses it's 3D models for explicit going ons. As for the anime type porn game games, which do seem to take up the biggest share of H games, it's a bit more than just drawn art. Most of the time you get voice actresses for that, sometimes even graphic FMV to go along with it now. And add to that, it seems as though a good percent of the time the girls presented in the anime type H games are underage.
Compared to all that is out there the best analogy I see The Guy Game has IMO is with The Yakyuuken Special but not sure if I've ever heard anyone condemn that game, other than consider it silly.

I would be interested in knowing where the footage for this game was filmed...if it happened to be somewhere where the age of consent was 17...well then, wouldnt there be no basis for the case?

The age of consent in Texas is 17... In New Mexico I think the age of consent is like 14 or 15. The problem is that anyone under 18 in any state is considered a minor and that is why this case exsists because it's illegal for a minor to be photographed or filmed in any sexual way. All age of consent mean is that they have the right to consent to themselves for sex. For example in Texas where the age of consent is 17, it is legal for 17 y/o to consent to have sex with an 18+ adult. Also Age of consent means that a 17 y/o in Texas does not have too consent to their parent over their actions. (ie. they can move out)

And it STILL looks like you can find this game for sale in EB's -- I saw the PS2 version (used) in one of my local ones last week. I want it, but I'm not paying $25 for it. :/
