Legal Advice - Dealing with Stupid Seller

I won't bore everyone with the little details, but...

I won an auction for a computer on eBay that was advertised as factory sealed but it had been opened & resealed (he had a user account set up on the computer). It also lacked internal bluetooth, which the seller claimed it had.

The seller has been VERY uncooperative, so I filed a complaint with PayPal. He has agreed to refund my money once I send the item back.

In the meantime - he's threatened me with a lawsuit if the computer does not come back to him complete. I have a feeling he's going to lie & say I kept something or damaged it intentionally before sending it back.

Is there anyway to proove what I'm sending back is complete? I've thought about video-taping me packing it, but I'm not sure that would hold up if I were sued.

Did you pay via credit card?

My only advice would be to take a few picutes of it before you send it out. He's already lied to you saying it was factory sealed when it was not, so i think he's blowing hot air when he says he will sue you.

Yep. I paid with a credit card through PayPal.

I figure I'll wait and see if he'll refund my money through PayPal & if not, I'll dispute the charge with my credit card company.

Sad situation :(
As already mentioned, take some pictures of it before you send it.
Also get some witness(es) to see what condition it is in before you ship it.
I doubt he will sue you, but to be on the safe side get some witnesses and take pictures. I hope that should do it :)

He's probably just mad because you were smart enough to figure out his scam, so by threating to sue you, i bet he's hoping you'll cave in and keep the computer.

Either way he's dishonest, and a very bad seller.

You can have it packaged and shipped from a third party company like Mailboxes. you can have them document and be witness to what was shipped. Unfortunately they'll also charge a pretty penny for their services.

Man I just read through that website that jaybird posted. Sounds like this situation aught to keep you busy for a couple of days.
