View Full Version : Selling a BETA disc, what will happen to me?

If I were to sell a BETA disc on eBay BIN one day auction, and someone bought it, eventhough Im not allowed to sell this beta, what will happen to me?
Will sony get ahold of me and try and take me to court or something?
Or once I sell the disc am I free of charge?
Anyway I was wondering if any of you have ever sold a BETA disc you were not supposed to sell and what happened.

Here is what sony says:

Section 4. Confidential Nature of Beta Test Materials. You acknowledge and agree that:
A.) the Beta Test Materials are the confidential information of SCEA;
B.) the Beta Test Materials are pre-release materials and not intended for public release;
C.) the Beta Test Materials may be serial numbered for tracking purposes and would be traceable to you;
D.) disclosure of any part of the Beta Test Materials to any third party, including but not limited to any trade or consumer press, news agency or any competitor of SCEA, will cause significant and irreparable harm to SCEA, the extent of which may be difficult to ascertain.
Accordingly, you agree SCEA shall be entitled to injunctive relief as well as all other legal remedies that may be available in the event you breach this agreement.

Consistent with our policy, Sony Computer Entertainment America, Inc
(SCEA) will make every effort to identify those in violation and remove you from the Beta Program as we have done with all identified violators in the past.
We take the Public Beta Click Agreement very seriously and will enforce the removal of all violators of this agreement.

There aint much that could happen to you, you could probably do a 7 day listing on it, and sony would never find out. even if they did, why would they go after some guy selling a beta disk on ebay? it doesnt sound like its worth their time. Now if you were reproducing it and selling it on ebay, thats a different story.

I would wait until well after the game has been released. This will reduce the amount of attention sony gives. If its a game that hasn't been released yet, I wouldn't sell it.

Seriously though, I would'nt worry about. People sell beta stuff all the time. If its a serious concern for you wait till the full game is released.

If you try selling it on ebay, your auction will most likely be shut down within 1-2 days. Do it for a 1-day listing on saturday or sunday and you can probly get away with it fine.

You'd almost certainly end up in federal pound-me-in-the-ass prison. If Sony is willing to take on little old Lik-Sang, certainly they would go after the great and powerful PDorr3.

If Sony doesn't know nothing will happen. eBay sure isn't gonna tell them. However ebay will shut the auction down if they find it.

If you want to know what the legal penalties for selling the game are I suggest you read the Breach of Contract section of the papers you signed. It will outline in detail what will happen should Sony pursue the matter.

Has the game been released yet? If so, then you're fine. If you were a beta tester for the game you could get in some trouble, but I doubt it. Otherwise don't put the words beta, proto, alpha, or anything like that in the listing and you'll be fine. Use "developer disc" or "sample" or something like that.

Anyway Im gonna have a got at it, I will let you guys know if the sony fraud squad comes knocking at my door anytime soon.
Also this is for the swocom3 beta disc, the game is coming out in october and currently the beta is still active, I can get approx $100 for the disc.

Well my disc sold on ebay BIN $100 30 mins after I posted it. Buyer paid already, even paid $20 to have it overnighted.

wow that's crazy, but I guess since it's a beta disc that someone really wants I can see it going for that, well great going for getting that amount for it :D
