View Full Version : Item not recived, shall I complain to Paypal?

About a month ago I won 2 GBA games from a US seller on Ebay, but I still havnt recived anything. I e-mailed the seller several of times during the last 2 weeks, but never recived any answer. I e-mailed him directly and also used the contact feature through Ebay. Its possible that he sent it with surface mail, then it can take upto 8 weeks to Europe.
What I know Paypal complaints must be filled within 45 days so if I wait 8 weeks it will too late to complain if I dont recive anything.

I think its strange that the seller doesnt reply back to me. I have seen that he have started new auctions so he have been active on Ebay.

The thing is, should I fill out a non-item-recived at Paypal?
What I understand you can only claim your money back 3 times each year through Paypal and I have already filled out a complaint this year. Im not sure If I want to use one of these complaints for a purchace that was $30.
What if I use all 3 complaints and later I dont recive a item thats very expencive?

Any tips/ideas what to do?

The chances of you actually getting your money back 3 times in one year are pretty small. Even if you file a complaint, most times that is enough to get the seller to send you the item if they haven't already. If the GB games arrive then you can close the complaint, no problem. Hopefully filing a complaint will be enough to at least get the guy to talk to you. If he can't provide tracking information there is a very good chance you'll get your money back. I've never heard of the limit on refunds either, if it is true I'd really like to know.

You are limited to three PayPal Buyer Protection refunds per calendar year.

I dont know if this only counts if the seller have Buyer Protection or if its any Paypal payings.

Is he ignoring your e-mails, or could he be away on a break or something. If he still has auctions going and stuff I would file with paypal and/or ebay. I have only had to file a complaint with paypal once when I only received half of an order. After a few weeks they refunded me the balance.

Ye, i thought he/she might be on a break or something, but since he/she have started new auctions after I have sent e-mails the seller have been active.

I filled out a complaint now, lets see how it turns out :)

Good luck with the complaint.

I filed a complaint against a seller in France "Ziria34"

They sold me a Segagaga ltd edition DC box set for $104 inc shipping to UK.

I believe they got themselves purposefully banned after I bought it and paid for it (of course straight away) with buy it now and Paypal.

I filed a complaint as instructed when I rang ebay + paypal.

They said if he didnt respond to the complaint that I would get a full refund instantly, automaticaly and not to worry as his funds were frozen in his account.

It took them 1 month just to grant the claim in my favour and they only refunded $79

The rest of the money they were supposedly unable to claim because the seller didnt have enough in his account.

Id actually said to Paypal.. its taking you so long, what if he withdraws all his money? and they were like oh no its all frozen.

Ive been told today by Paypal thats B/S also after speaking to a totally unhelpful guy, he said he spoke to his supervisor and I was going to get a $25 "appreciation credit" or something i.e. "we're not in the wrong... heres some money.. shut up"

As yet (few hours later) not got it. I think it was just to get me to shut up and go away..

Dont expect to get it.

Yet when ive had 2-3 complaints filed against me (items were sent out!) the people got ALL their money back.

Doesnt leave me with much faith in Paypal at all.

One thing you absolutely should do is when selling items on eBay, *always* get shipping service with tracking. That way no one can say they didn't receive their package. You also have to be careful when sending to other countries because the USPS doesn't offer tracking for that. You can get screwed pretty easily that way. As for the limit of three buyer protection claims per year, I think you can still do a claim without it being a "buyer protection" claim. I made a claim against a guy and got my money back and he doesn't have the buyer protection logo in his seller info. The other possibility is that they banned him from buyer protection because so many people were making claims. I guess it depends on how much you buy and how lucky you are as to whether you'll need all 3 in one year. What I have noticed though is that almost every time I have a problem someone else had left feedback previously about some related issue and I ignored it because I really wanted the item, or something about the listing just made it seem like the person was a real jag-off but I ingored that also because I wanted the item. Only a couple times has everything seemed kosher and then two weeks later I'm woindering "where's my shit?".

I complained to Paypal...and then the guy refunded all of my money. When I sent the claim in. He wasnt responding to any of my e-mails...but that worked.

And btw, with reference to what I said above, I googled the sellers email address.

Bingo.

Came up with a forum post showing his age, rough location in France, type of car he drives, and best of all, his telephone number.

Rang it.. got answering phone..

Then I found the gem of gems, his work website in his profile, and he's the website admin! So I rang the shop, and I asked to speak to him, and it was him on the phone!

He made some half ass excuses (how can you make excuses for a scam)

Obviously scared I had all his info, he's apparently going to post me my money back...

We'll see!

I recived the games today! Woohoo :D
They were sent 12 sept. I saw and I payed 22 aug.
So he was just slow to send them. Anyways, I got them and thats what matters :)
