The buyer got a positive feedback from the seller for fast payment. I doubt that the buyer was aware of that this auction only contains a photo. Doesnt auctions like this goes as scam? Even if it says that its a photo, the auction is set up in a way that it looks like a real xbox 360 thats for sale.

I would say that is a little scammy. He didn't really word the auction to let people really know that you are bidding on an actual PICTURE of an xbox 360 system, not an actual system. Kinda made it sound like you are bidding on the system pictured.
Oh well, I'm sure that guy will be filing a complaint once he receives a picture instead of a xbox.
Sucks for that guy... "Man I can't wait to get that xbox 360 Im so excited!"
A week later... "WTF!"

This auction is for the photo only.
Well when the seller kept repeating that sentence over and over in the description, I would have realized something wasn't right. The seller didn't do anything wrong. He specifically pointed out it was just a photo. Oh well, someone is going to be pretty dissapointed.

Ye, but the seller must know that someone in their right mind wont pay $329 for a picture of a Xbox 360. I guess the low price made this guy jump on the BIN button so fast that he didnt think of reading the description.
Ive been burned sometimes on this, not reading the description. Only small stuff compared to this tho. Once I won Arkanoid 2. I thought it was for NES, but the description said it was for PC. Didnt notice this before I recived it hehe. Also once I won Mega Man 1 - 6 and when I got it I see that the manual for Mega Man 1 was photocopy. I read the auction again and it said that the manual was photocopy. Ah well :)

Seller didn't do anything wrong. Buyer is an idiot for just bidding on it without even actually reading it fully. I mean, would you blindly sign a contract without reading it as well? Especially if it's nothing more then the same sentence repeated over and over? No. How could you not even notice that? It's all the buyers fault. If Ebay/Paypal have something to say about it, fuck them.

But what if the buyer is a non-native English speaker? He/she may have interpreted the auction as the items that are in the picture. And that is misleading.

Yeah, I hate the caveat emptor mentality of practically everyone both on eBay and here. This seller is clearly intentionally trying to rip people off, and he deserves to be banned from eBay because of this. Should the buyer have been more careful? Yes. But still, I'm sick of douche bags like this seller cluttering up eBay with their bogus auctions, and I'm tired of douche bags on this website sticking up for them when they do it.

There is nothing ethical about what the seller is doing. No one would pay that kind of money for the picture and he knows it. The seller is counting on people not to read the full description to bid on this item. It is deceptive selling and he can and should be suspended for doing this.
Yeah yeah the buyer should read the text but if your aunt logged on to ebay for the first time and bought this for cmas how would you feel about it them? Thats who ends up bidding. First time bidders with less knowledge in eBay deceptive practices. Scamming people is never right.

Within the sentence, they say photo/graph 3 times, 45 times in all within the description, and 48 times in all.
Also, like jdchess mention, .99 shipping for an Xbox 360 is quite... low.
I know that the seller is intentionally trying to rip people off, but it's not his fault that people are stupid enough to buy it.

I did mention that the shipping costs should have been a tip off also, but I in NO WAY meant to imply that I thought it was only the buyer's fault. The seller was obviously trying to mislead and SCAM someone. There is no other reason to post an auction like this.

And why should the cheap shipping have been such a red flag? I know of many places online that offer free shipping if you spend over $50-100. Also, the buy-it-now price is $320 which is 30 bucks over the price of the core unit(meaning the seller could have upped the price of the unit to include any shipping charges).
To repeat, yeah the buyer is foolish for not reading the auction more carefully. The seller is a POS for attempting to deceive potential buyers.
Some of you people mean to tell me it wasn't an intentional deception? He wanted $320, with a hasty buy-it-now option, for a worthless photograph! How much more proof do you actually need?

They are saying that since the buyer didn't read the description it is ok to rip them off and thus they don't have any problem with it. A seller like this is the same type of person who gets the elderly to sign over the rest of their savings for swampland in Flordia. If you don't have a problem with sellers like this well that says ALOT about you.

Someone should put a bid up of X-Box 360, the words written on a piece of paper with a ink pen. And sell it for $250. They should even post the picture of the paper that the potential buyer is bidding on, and even write "THIS IS NOT A SYSTEM, THIS IS A PIECE OF PAPER WITH THE WORDS X-BOX 360 WRITTEN ON IT!" over and over again. If someone actually buys that, good lord, I lost faith for all humanity, and people stupid as that don't deserve to be sticked up for. I'm sorry, but they don't.

Another thought what if the bidder wasn't born in the USA. What if the bidder can read and speak English but not as well as we do? Why would the bidder think this is for anything but a 360 ?

It makes me ill to my stomach when I see these type of auctions. Both the seller and the bidder and any other bidders on this auction should be blocked from using Ebay.
These type of auctions destroy Ebay's integrity for a safe and trusted trading place just a litte bit more every time.
Over the last couple of years, I have seen this kind of stuff creep in slowly more and more, until now it seems an almost generally accepted practice.
Pretty soon, if this keeps going in this trend, Ebay will be known as the 'place you will get scammed'.
I make a living using Ebay. I view these type of sellers as taking away a future potential buyer from me, because if they have a bad experience, they may not use Ebay again.

I agree that this is a low tatic.
this should result in suspension of that account and also a refund of the buyers money.
i also thought about the amount of US citizens buying on eBAY that dont know perfect english.
this is a rotten attempt at making money.
