Would you consider a system that have been tested 1 time as brand new? Like if you take a SNES out of a box for the first time, try it once just to see if it works and put it back, is it still brand new?

I'd say technically no. But I'd be more likely to buy a tested system than a non-tested one.

Im kind of with Wester on this one. but i think if you're selling to a private buyer it should be concidered new.
Edit: Think about it in context with theese Xbox 360 problems. Would you want to take a chance? Or would you want one that you wont crap out in the first few hours.

What context? Who is doing the testing? If a consumer takes it out of the box, tests it once, and tries to sell it to me saying it's brand new... I don't think so. Or a retail store. Manufacturer tho, sure.

In order to test it, you have to use it, making it used and not new... to me a new system is one that is never played.

If its been opened, it is no longer new. Even if it was just to test it.
If a game is only opened to be tested, is that considered new? I don't think so.

A game system is not new unless it is completely sealed and untested. If when selling it you offer the buyer the option for you to test it before sending it, you can still sell it as new then. But opening a system up, testing it and returning it to the package no longer makes it new.
Would opening a game, sticking it in a system, playing it for 10 minutes to make sure it works and then returning it to the package make it still new? Same concept.

i think testing a game and putting it back would be considered CIB mint, and a sealed one would be NIB, alot of people have their own way of opening games, and one person's preferences aren't necessarily another's, to me it's not NIB if someone else has handled it for any reason, the only difference between a used one and testing one is the time spent doing it.

Im on the side of everyone else saying that not really it's not new
because once's it been opened it's not new anymore
new to me is if it's always been sealed and never been opened.

If its been opened it cant be considered new. By the looks of the poll most would agree that to be right.
New would be sealed, unopened, and untouched. I would consider it mint condition, since it is still in top shape with little use.
Once the system has been turned on, it's no longer brand new.

I don't think it's 100% new. It's more like 25% new.
Something that totally pisses me off is going to GameStop to get a "new" game, and when you get to the counter they pull a sleeve from under the counter and place the disc in the case. Sometimes I've looked at the disc as they put it in and it's scratched up. This totally pisses me off. They broke the seal to the game case and then somehow scratched up a "new" game.

No it is used.
If i was to open up a stick of gum and cheew it for 3 seconds then put it back in the foil wrapper, is that used? Then try to sell it as new gum? Hell yea. Even if I try to say i was testing it to make sure it had the flavoring in it.
Used is used no matter how you slice it.
