If it's open with no case or manual shouldn't it be Mint or Like New?

Actually, it is brand new. It's from Sega-parts, and if you look on Sega's website, they name Sega-parts their official replacement parts website. A few of their Saturn titles are listed like that (SF 3, Dragon Force--sold out though)
I've ordered a few things from them so far with no problems

Yeah, I picked up a loose Dragon Force from sega-parts.com, and the disc looked like it had never been touched by human hands. Still, you've got to wonder how these mint-condition discs wound up without cases or instructions.
