Well, I bought a Captain Novolin for the SNES on eBay that was supposedly MINT and SEALED, but of course it was mailed out in a bubble mailer and came in horrible shape.

Sure the fact that it was mailed in a bubble mailer led to smooshing on one side, but it was already in crappy shape to begin with. The seal was scratched to heck, had a gaping 3+ inch piece torn out exposing the box, two ugly inch long parallel scratches on the box, numerous seal tears including a complete split on the top right edge.

I emailed him concerning the problem in a civil way. He replies saying he's sorry, that he was only describing the cartridge (OMG, he's got X-Ray vision!), and that he hopes we can still have a "good buyer/seller relationship".

I email him back asking for a refund because it was not as described at all. Here is his title and description:

"Captain Novolin,Super Nintendo,RAYA SYSTEMS,MINT,SEALED"

"THIS IS THE RARE CAPTAIN NOVOLIN GAME FOR THE SUPER NINTENDO. YOU PLAY AS SUPER HERO FIGHTNG AGAINST DIABETES. IT IS IN MINT CONDITION AND IS SEALED IN ORIGINAL PACKAGING. I YOU HAVE ANY QUESTIONS FEEL FREE TO CONTACT ME AT ********@YAHOO.COM THANKS"

Only a stock picture is posted.

He emails me back saying that since I received the game, and that the cartridge itself was what he was describing, he would not offer me a refund.

I was furious, but I emailed him another civil reply that if he wanted to continue a good buyer/seller relationship, he should give a refund, ESPECIALLY since the item was not as stated. I explained that had he made the distinction that the "cartridge is MINT, box and seal are poor" he would be in the clear. But he said the entire game was MINT and sealed.

I paid him within 24 hrs of auction's end through PayPal.

It was only $18ish total, but I want to know what kind of recourse I have with a dishonest seller, now AND for the future.

5 Days since my reply and I've only been ignored.

Help!?

A CIB copy is worth more than $18 even in that condition. If you are so unhappy, just resell it and keep the profit. In fact, I'm willing to bet that you can get $30 right here on DP.

Yeah, you know, I don't mean to belittle your problem because it is a legitimate one, but I'm blindsided by how sweet that is, even in crappy shape.

I understand your frustration. If i won a damn cheap sealed game and it wasnt mint as described i would also be pissed, even if i didnt pay much for it. I guess you wanted it for your collection and the price isnt the issue here.

If the seller doesnt respond there isnt much you can do. If you payed with Paypal you can fill out a complaint saying that the item wasnt as described. But you must most likely prove it and if the seller have emptied his Paypal account its not even sure you will get any refund.

No you don't. I filed 15 of these "not mint" claims and got my money back for all 20 games in the transaction. I had to wait two months but i eventually won.

With a single itme like thiis the buyer will automatically win.

I filled out a complaint not long ago because i didnt recive 2 PSX games. The seller was even NARUed on Ebay. It took 2 months before i got the final answer from Paypal.


Our investigation has revealed that the seller is at fault; as a result, you would be entitled to your share of any funds recovered, but unfortunately no funds were recovered. If this transaction occurred on an auction site, we encourage you to contact that auction site, as they may provide you with insurance coverage.

Since i filled the complaint 1 month after auction ended and it took Paypal 2 months to give me that reply its too late to complaint to Ebay. Ebay complaints must be filled within 60 days after the auction have ended.

Here is some other reply i got earlier, same case.


As stated within the PayPal User Agreement, the PayPal Buyer Complaint Policy does not guarantee recovery of your funds, and recovery is done on a best effort basis. The amount refunded to you represents the total amount PayPal was able to recover from the seller's PayPal Account. Although the claim is closed, the dispute is noted in the seller's account records, and the seller will need to complete the refund to you if he/she wishes to continue the use of PayPal's service.


Sad, but true :(

The paypal filing is the same as an ebay filing. If you try to file through Ebay they kick you over to paypal's site. They work together as one unit.

May be not back then when you filed --but that's how it is today. You get back $$$ - $25 ebay fee.



Also credit cards can provide a last resort. I always pay my paypal bills with Discover to later dispute the charge. Recommend you do the same.

I did try to fill a complaint at Ebay too, but got the standard reply that its been over 60 days etc.
I didnt get a cent back. I lost about $42, glad it wasnt more.
For the creditcard refund, I can always call my bank and ask, but i doubt they will do anything. Its been too long also.

I cant belive that someone wants to make themself a criminal for that pity amount of money.

I believe you. My point-- if that happened today paypal dispute would automatically be converted to an ebay dispute. You get back your Dollars - $25.

How does it work? Do i get the $25 to my Ebay account so I can sell stuff or will they got to my Paypal account?

Say you bought a $40 item.

File paypal dispute. Win. They can't recover the funds so they apply EBAY'S insurance. You get $40-25 fee = $15.00 back. Credited to paypal.



A credit card dispute gets you back all your money. (And forces paypal to lose money.) My Discover card said they'll do any dispute up to 1 year's time.

I must say that I agree with the buyer on this one. The game was not as described and the seller's excuse was LAME. Describing the cart? Please. File a dispute with PayPal and neg him.

I ALWAYS pay PayPal with a credit card. They don't want you to... it always takes you to that screen where it tries to get you to use a Bank Account and talks about all the shitty advantages. They DON'T mention that they have to pay Visa/MC fees AND that you can file a claim if need be. I haven't had to yet. I still HATE PayPal but not liked I used to. They have gotten much better.
