Ok, I won an auction today for a complete TG16, with box and everything, and 11 games as seen here:

Yeah, I won the lot for $51 plus some incredibly high shipping ($35). I email them to get an updated invoice because I wanted to add insurance (they didn't offer it).
A few hours later, I get a response from them:
dear buyer unfortunatly i have some bad news just return today from grand lake fishing, live in colorado had a snow storm over weekend came home this afternoon to find basement flooded from broken pipe system was completley under water as no longer works everything was destroyed very very sorry
It's pretty fucking obvious their TG16 lot didn't sell as high as they wanted. Hell, just look at the bidding history (me and some other dude, I beat him by $1).
Ah well, what can you do? People on Ebay think the TG16/TurboDuo/PC Engine is some kind of goddamn holy grail of videogames. And it doesn't help matters when you have assclowns like Bullseye selling Duo plus a game for $400!!!

Well just watch the auctions for a while.... If the games start to trickle out or the system trickles out a little later, then you 'might' have a leg to stand on to get them a bad mark.
If your really certain that they didn't actually have a tragedy in their house, then ask to see a picture of the damaged system and games.

Tell him you'll take it waterlogged for a 75% discount (even if it is flooded, it can be dried out, cleaned and I am 99% positive it will STILL work). If he still refuses, he is reallky lying. At that point inform him that if he does not complete the deal you will file an ebay complaint against him.

No mention that the item was destroyed.

Haha ye, that reminds of a simular case i had.
I won one of those handheld Tiger LCD games (this was Mega Man 2 or 3). I got a mail from the next highest bidder where he asked if he could buy the game for 3x the price i won it for. I said no because i needed this game myself. Didnt hear more from him.
So I payed for the game and a few days later i see the seller have refunded the money. He said that he dropped the game on the floor when he was about to pack it and it got damaged (ye right :roll:).
I was 99.99% sure he sold it to the next highest bidder who wanted to pay much for for it so i confronted him with this. First he said he didnt sell it to the other guy, but then i said i spoke to him. Then he said he had 2 copies and sold the other copy to this guy lol. I asked him to send the "damaged" game anyway, but what do you know, he had threw it out in the garbage and they had already picked it up haha. Fucking bad seller. I didnt even get to neg him because it went over 90 days and i didnt know you could leave feedback anyway.
I did find the same game later so it didnt matter that much, altho i was very pissed when he didnt send it. You will probly find another Turbo-Duo bundle again :)

This is why lousy sellers still exist on ebay. People do not report them. At the very least you should file "non-performing seller" to Ebay to protect US - the future buyers.
It only takes 1 minute.

hello again just wanted to check if you got message yeserday and apolagize once again , and tell you how very sorry iam about game i find them alot and will keep trying to find another one for you i have kept your info and try to get another.

He sold it to someone else a backdoor buyer. Man that sucks. I would ask for proof. Like suggested before send a pic of the damaged goods. Send him a nice letter back stating you need proof. See what he says. A man on the up and up will have no problem getting you pics. If you are gonna get screwed at least let him squirm.

And I've got a guy refusing to take my paypal payment. Keeps rejecting it. Pisses me off. Why bend over & kiss the butts of these clowns?!?!? Why give them the benefit of the doubt??? According to Ebay:
If a seller has refused to complete a sale, and payment has not been sent or payment has been refunded, report the seller. Make sure to include a copy of the email documenting the seller's refusal to complete the sale with the full message text and complete email headers when making your report.
If a buyer has paid for an item and has been unable to receive the item or a refund, or believes the item was significantly misrepresented, they should refer to the eBay Item Not Received process. Buyers will also find instructions that will allow them to contact eBay to report the seller on this page.
After receiving a report, eBay will consider the circumstances of the alleged offense. If a complaint cannot be proven with certainty, it is possible that no action will be taken. Due to privacy issues, eBay will be unable to discuss the result of the investigation.

Now, seller says the item was ruined or destroyed and I call bullshit on it, how can I prove it? I mean, we all know what probably happened but I don't think Ebay is gonna do much more than wag it's finger at the seller.

You don't. Odds are good this guy's done this before. 3 Times and he's automatically suspended. I got two kicked off last december. (cheer)
Filing a Non-performing Seller takes no more time than filing a Non-paying Buyer Dispute. 30-60 seconds tops.
Filing a non-performing seller report is essential to the integrity of eBay. Otherwise, anyone will think they can get away with this. It's like caving in to bidders who email you complaining about the closing price and wanting it for cheaper: the moment you cave, that's the moment you've undermined the integrity of the auction process.
Report the item, so at least the seller thinks twice about doing the same thing again.

I can't believe you asked that. What is it with you people being friendly to Dishonest Ebayers?????? These people don't deserve to be treated with friendliness. They deserve punishement. You already gave him plenty of time to Sell the Game.
Just file the Dispute.
He can respond to that or argue with Ebay that it's "unfair" or whatever. Hopefully this is his 3rd Strike so he'll get instantly suspended.

ebay doesnt do crap to non-performing sellers. Hence the "privacy of the decision" it's their way of making it sound like they're doing something when they're not.
Ebay doesn't care because either way they still get paid.

ahh man...I would've said yes to this guy! I would have told him once I get the item I'll sell it to him and then never contact again ;D.
As for the turbografx, sorry to hear it man! Oh well, perhaps you'll score a nice duo lot in the future. I'd recommend it too, since you save money on the turbo cd system which I don't think looks ANYWHERE near as nice, and you don't have to buy a stupid system card. Duos may command a bit more money, but they're worth it when you find the right person selling it. To HELL with Bullseye and wanting to retire off his turbografx collection!

Takes 3 strikes to remove a seller or buyer.
It might appear nothing has happened but you've left a nice Black Mark on this Seller's record (invisible but it's there). If refusing to sell is a habit he will soon get suspended.
I got 2 sellers suspended last fall--- few days after my report they were banned. And 3 buyers kicked off.
Very satisfying. LOL

Just because you send a complaint to eBay doesn't necessarily mean that they issue a strike against the seller. It all depends on what they decide based on their investigation if they even bother investigating. Again, the reporter doesn't get told what action eBay takes if any.
