I bought some clothes from a seller that were "new", got them and they weren't new at all. Stained and drenched in cig smoke. Contacted the seller twice and no response.

So I wait for the 93 day mark, I leave her neutral feedback since she did ship them fast and the stains and smell came out after I really washed them good.

Today that bitch left me 2 negs and a neutral.

My Feedback (http://feedback.ebay.com/ws/eBayISAPI.dll?ViewFeedback&userid=jgw2246&ssPageName=STRK:ME:UFS)

How does one justify leaving me a negative when I tried contacting her and left her neutrals? And it's not the first time someone complained about her "new" clothes.

Dude, when you left the feedback you lost your ability to retaliate. This wasn't a smart move.

I thought she couldn't leave me feedback already. I knew I shouldnt have left any feedback but was hoping there wouldnt be any retaliation.

Why the hell didn't you file an "item not as described" report?

I think Kitsune's right. It's like a dispute between siblings: If you want a fight, you'll throw a punch--but if you want recompense, you'll tell Mom or Dad.

Of course, I always threw punches instead, but that's only because my parents are pretty shitty. But eBay's better! LOL They're kept in check because they have to make money, and they can only make money if people feel secure using their system.

I tried but since it was during Christmas time it got overlooked and pushed back and then when I filed it Paypal said it has to be within 45 days of the transaction date and it was like the 46th or 47th day. Sucks balls.

The seller defrauded you out of your money. Why would the seller hesitate to lie? Steal. Lie. It's par for the course & obvious it would happen.

What you should do is call your credit card & file a dispute to recover your money.

Contacted seller twice, no response, stained and drenched in smoke is not new!!! File an Invalid Email Complaint. Might get her suspended.

Then check her phone number. If it's disconnected file a second Complait - Invalid Contact Information.

This is what she said:

WOW IS RIGHT THAT IS HOW I FELT TO SEE MY FEEDBACK FROM YOU 3 MONTHS LATER AND TO LIE ABOUT STAINS ON THE ITEM NOT TRUE! YOU HAD MY ADDRESS YOU SHOULD HAVE SENT ITEMS BACK TO ME YOUR FEEDBACK WAS WORSE THEN A NEG. TO ME SO DON'T TELL ME BECAUSE YOU ARE SO NICE I DON'T THINK YOUR COMMENTS WERE NICE AT ALL ~ I LEFT A NEG TO YOU BECAUSE YOU ARE NOT WELCOMED TO BUY FROM ME AGAIN - NOW YOU ARE ASKING TO WITHDRAWL MY FEEDBACKS WELL YOU CAN THINK ABOUT DOING THE SAME FOR MY FEEDBACKS AS WELL

And I responded with this:

Honestly, the sweater did have stains. I did contact you about my allergies too since the sweater was drenched in ciggarette smoke. Karen don't act suprised like you never had complaints before, look at your previous feedback. You have many complaints about smoke and not new items. In my feedback I was to the point and honest, not like yours, I can contact ebay and have them remove it since it falls under slander. I sent you the request to withdraw so we both can remove the ratings we have given each other. You can not leave feedback again after it has been withdrawn. I can't believe you think that I am only trying to retaliate and mislead you then leave you negative feedback which is not possible. If I wanted to leave you a negative I would have and could have when I left the neutral. You could have done the same for me at least. You could have left the same comments but as a neutral as well. And why would I send back the item if you didnt respond to me? If I am not welcome to bid on your auction then block me not neg me. So it's up to you if you want to mutualy retract our feedback. To me it doesn't matter because I stated the truth and it wont affect my sales at all.

Lets be honest here, you waited three months before you left feedback because you though you'd be able to pull a fast one without concequence. Most people are going to take offense to that. When the seller found that they can in fact still leave feedback for you what kind would you have expected?

I agree with Kevin, if the item arrived not as described and in poor condition you should have contacted the seller and demanded a refund. If she was unwilling to do so your next step would have been to file a report with eBay and PayPal.

Personally I think the entire idea of trying to leave bad feedback at the very last second as being cowardly.

Dude seriously, did you read the thread? No Offense.

I tried to contact her and I did file with Paypal and ebay just refers you to Paypal if you paid using Paypal.

This is her final response, just wow.

I Left the truth in your feedbacks you are not welcomed back to my auction as the truth and reason be shown from you HARRASSING me in your e-mails prove & say enough.

Harrassing her?? Wow I was just "Contacting my seller" like ebay said to do. Go figure.

My final response:

Harrassing you? I guess a simple interogative statement in detail is considered harrassment. I will forward this to ebay for you. Thank you for your time and have a great year.

I once bought some CD's on ebay. They turned out to be burns. I got my money back and somehow convinced the guy that I wasn't going to leave feedback unless I got good feedback first. I however, never said what kind of feedback I was going to give. I decided to wait until he had a bunch more cd auctions up before giving him the worst neg ever! Then I forgot till after the 90 days and life went on.

Did YOU? We gave you some good advice. Are you going to follow it (file a dispute through your credit card) or just keep bitching?

No Offense.

Try sendng her a >friendly< message: "I'm sorry I gave you a negative-sounding feedback. I want to delete it. Do you agree with this? If yes please click 'yes' on the mutual withdrawal form."

I personally think you got reamed, XianXi...

Of course, hind sight is 20/20, so in retrospect it would have been better not to leave any feedback at all. However, we obviously cannot change the past. The person who you are dealing with is clearly very close-minded, and not willing to listen to reason. It's tough to deal with people like that, and it's ultimately very frustrating. I feel for you...

I think the only thing you can do is just use it as a learning experience and let it go. This seller's not worth the aggravation.
