I won a BIN auction and before 24 hrs were up(it wasnt a immediate pay auction) I started getting abusive emails. The seller sends me serveral emails calling me a deadbeat buyer, using racial comments and tons of profanity. I emailed the buyer saying his comments were uncalled for and I no longer would be sending payments since I do not appreciate his emails or trust him. I also asked him to stop emailing me. Well needless to say, his behavior got worse. I don't really care about his threats and emails, I just have two questions.
1) Can someone change a positve feedback into a neg? He left me a positive by mistake with a neg comments. He emails me all pissy about it saying he is gonna have ebay change it. Does Ebay do that?
2) I emailed ebay about his abusive emails. Will they do anything? All I want is for ebay to email him saying I would like his volgar comments to stop.

As far as I know eBay will never remove a feedback point. They may remove the content if it breaks rules such as containing personal info, is abusive, or have links in it but as far as I know they'll never remove the point itself.
As far as emailing ebay about his abusive emails, it really depends if the emails went through eBay's email servers or if they were personal emails sent from his personal email address to yours. I know that abusive email is against eBay rules but I don't know if they'd do anything about it if it was via personal email. If it was you can always contast his ISP and file a complaint through them.

Yeah, Griking is right. The only way to remove a positive feedback that doesn't violate ebay regulations is if you agree to the Mutual Feedback Removal, which obivously, you wouldn't.
As for the emails, you can report him all you'd like, but unless he is actually threatening harm to you (ie "I know where you live and I am going to come over and kick the crap out of you and set your house on fire."), all ebay will do is tell you to block his emails, no matter how vulgar.

Yep, ebay wont even remove feedback that contains swear word etc. It even says so in their rules.

Oh well, I really just love the fact he can't take back the pos. feedback. He was hot about it and emailed me twice to tell me it was suppose to be a Neg. and how he was working to change it. Gotta love when people get racist. He emailed, "you are a deadbeat buyer,%&*#@, you must be white". Funny thing is I told him I really wanted the game and my wife would be home in a few hours to paypal him. That was just before 24 hrs. since the end of auction. He ignored that and slammed me with insults and profanity.

Videogex is my user name. He continues to email me threats if I dont withdraw my NEG. Not a chance. He is pissed since he had perfect feedback. I wish he would have been civil, I really wanted the smurfs game.

Did you ask why he went crazy because you didnt pay within 24 hours? Was it stated in the auction if payment must be done within 24 hours?

Yes, the auction says that payment must be made within 24 hours, but still, is the seller an ass or what?

Yes it says 24 hours. But he got abusive before that sending me several emails. I emailed him back just before the 24 hr period saying my wife would be home in a few hours and I would paypal then.(my wife does all the paypal stuff) After a few more volgar emails, I emailed him saying I was no longer comfortable buying from him because of his behavior. I dont know why he got weird, he did state several times that he is sick of the deadbeat buyers like myself. I guess that may have been one reason. Trust me, I have been on ebay for several years and have never not completed a purchase. After all his emails, I wasn't about to send him money.

Not so much.
If you are not completing the transaction like you said above, he has a right to ask for payment, as often as he sees fit. Ebay will not do a single thing to him or his account if he is only being vulgar and sending stupid emails. You only have a case if he is making specific threats of bodily harm or demanding payment in a way that violates ebay policy (making up stuff about a collection agency, harrassing you outside of your ebay contact info, etc.)
I don't understand why you're not sending payment. Yeah, the guy sounds like a jerk, but you did win the auction. Do you really think he's simply not going to ship? Even if so, you will be using Paypal, so if you know your stuff, you will be able to get your money back fairly easy.

Not sure, they way i understand it they wont remove it. Here is a copy/paste from Ebay rules.
The feedback comment contains profane, vulgar, obscene, or racist language or adult material. Inflammatory language, such as "fraud, liar, cheater, scam artist, con man" etc., while strongly discouraged, will not be removed.
They might mean that only stuff like "fraud, liar.." wont be removed, but the othere will be.

They WILL remove feedback (not withdraw, it will be like it was never left) with racist or profane language. I have seen it happen myself

Abusive or not, you still owe the seller money. He can file a Non-Paying Strike to your account.
Would forward these to ebay as harrassing & then pay the man.

If he sent you abusive and racist emails through eBay's email server then eBay will probably do something about it. They'll ask you to forward the email complete with the header info to them before they'll do anything though.

Abusive or not, you still owe the seller money. He can file a Non-Paying Strike to your account.
He wont take payment after 24hrs. He will relist the item with no warning after 24hrs have past. Sellers that demand payment within 24hrs are retarded, you need to wait at least 7-8 days before you can file a strike.

I know you're generally pro-seller, but that attitude is inexcusable in a professional transaction. Think of it this way, the seller doesn't have to sell to you if you don't adhere to his strict regulations, then I fail to see why you should pay him if he can't even follow a few simple rules of common curtesy. He can be strict without being a verbally abusive son of a bitch.

I dealt with one seller who demanded payment within 24hrs and I paid him within 2 and that Bitchtit took 2 weeks to just ship it. WTF?!?!

He clearly states that after 24 hrs he will relist the item. I don't see how he can demand money because of the above policy? Even is he demands money, I can just email his volgar treats in defense. So now I need to find a copy of Smurfs(PAL)...hint...hint...

I ask Ebay about a seller who wrote "pay in 3 days" 'cause I thought ti was a violation. Ebay confirmed YES the seller can set whatever terms he wants. Including 1 day payment.
The solution is to not bid.
Or if you didn't see that requirement-- and seller demands 1 day payment--- then demand fast delviery too. File a 'item not received' dispute with Paypal on day 2. LOL

Ebay IS different. Ebay equals signing a contract to buy. EXAMPLE - I may think MSN internet sucks but I signed a 1-yr-contract. I'm stuck with it. You can't just back-out after you've signed that contract. Ditto Ebay.

Ahhh two sides to every story. The OP did >not< pay during until day 2 or 3. No wonder the seller thought he had another Non-paying buyer. I can understand his frustration.

Absolutely not. You can report him, and AT BEST, ebay might send him a generic warning, but a one-time violation is in no way grounds for ebay to NaRU him. The absolute best you can hope for overall is that this is his seventh offense or so in a short time and ebay is sick of dealing with him.
Remember, ebay makes good money from sellers. They're simply not going to NaRU a seller for something as petty as a rude email (petty when compared to fraud and other crap ebay has to deal with daily). Based on this guy's feedback, it seems like this isn't a usual occurance.
Believe me, I've tried this many times with loser sellers I've dealt with. I'm not making this stuff up or guessing.

Personally I'd consider racist comments a "misuseof eBay's forwarding system" but hey, that's just me.

Do you mean in this specific case, or in general? In this case, the buyer chose not to pay, so the buyer filing a complaint would be baseless. In general, when a buyer files a complaint for seller non-performance, all that happens is a form email and sometimes an official warning. It's one of those things that needs to build up before ebay will suspend a sellers account.

Here are a few emails from the seller:
after I was tired of trying to settle this he sent,
"I will fuck you over with a negative too. You damn whiny dipshit, how dare you disregard my auction terms then make up lies. FUCK YOU! I bet you're white"
Later after I asked him not to contact me he sent,
"I get it....... the guy who forced me to get tracking with all items was bmwsmallville. A guy who's been kicked off eBay twice. Your whining about me being unfair.... I think you know him. ellative, or he works for you... but you know him and you're getting revenge. I have to sell on eBay as my father is out o fwork thanks to a curropt labor union and I do not like people who don't pay. You try to ruin my eBay business, I will get you back."
I have no idea what he is talking about above. Never heard of him. I have saved every email I sent and his. I never insulted him or used volgar language. I just stated the facts and told him I did not want to do business with him becuase of his behavior and insults. He got way out of line. My next step is emailing his provider all his posts and possible contacting his local police since he has stated he will get me. Makes a person want to stop buying off of ebay. Too bad, could have been avoided.
And Kevin_psx, the guy started going off on me less than one day from the end of the auction. I tried to tell him I would send paypal in two hours but the insults continued. You want to talk about frustration. I doubt anyone would complete the auction after that. I neg'd him for his rude behavior & comments 36 hours after the auction ended. That should tell you we emailed each other well before that. Hardly 2-3 days.
