ST. AUGUSTINE, Fla. (AP) — A man who said he swung a baseball bat but denied killing any of the six victims in a dispute over an Xbox video game system will spend the rest of his life in prison, a judge decided Tuesday.

A jury on Tuesday recommended the death penalty for two other defendants.

Michael Salas, 20, was sentenced to seven life terms without parole. Death was recommended for ringleader Troy Victorino, 29, and Jerone Hunter, 20. All three were convicted last week of six counts of first-degree murder.

Chief Circut Judge Bill Parsons did not set a date for the sentencing of Victorino and Hunter.

Early on Aug. 6, 2004, four men broke into a house in Deltona, slaying the six victims.

Prosecutors said Victorino was angry with victim Erin Belanger, 22, who had him evicted when she found him living in her grandmother's home in Deltona. She kept some of his belongings, including some clothing and the video game system.

The jury recommended death on four of the six murder counts for both Victorino and Hunter. Life in prison was recommended for the other counts.

"I just wanted to tell the victims' families that I'm truly sorry," Salas said before the sentencing, adding that he made a "mistake I will live with for the rest of my life."

As the recommendations were read, Victorino did not look at the jury. Hunter flinched when the first recommendation for death was read but kept his composure, looking forward. Salas leaned back in his chair and sighed with relief after it was clear the jury had not recommended death for him.

Attorneys for Hunter and Salas had argued that their clients were intimidated by the 6-foot-7-inch, 270-pound Victorino, and wouldn't have entered the house if they had not been threatened and coerced.

Besides Belanger, the victims were Francisco Ayo-Roman, 30; Michelle Nathan, 19; Anthony Vega, 34; Roberto Gonzalez, 28; and Jonathan Gleason, 17.

Nathan's mother, Kay Shukwit, said that she was satisfied with the recommendation of life in prison for Salas and that he was not as "evil and vicious" as the other two men. Still, Shukwit said the recommendations did not bring any closure.

"Closure would be for someone to walk up to my front door with Michelle and say, 'Here's your daughter back,'" she said.

In closing arguments, State Attorney John Tanner had urged jurors to recommend the death penalty for all three men, saying the bloody frenzy turned into "a thrill killing."

But defense attorneys argued that their clients should be sentenced to life in prison because of their mental illnesses. Attorney Michael Nielsen said Victorino has bipolar disorder, and attorney Ed Mills said Hunter has schizophrenia.

Defense attorney Jeff Dees said Salas — who admitted swinging a baseball bat in the attacks — was a minor participant in the crime and has attention deficit hyperactivity disorder.

A fourth defendant, Robert Cannon, pleaded guilty in October to all the charges. But he later refused to testify and said he wanted to withdraw his guilty plea because he was innocent. The judge hasn't decided whether he will allow the change.

Do you think they played up the video game aspect of this in the media due to all the current hype over violence in some games?

I mean labelling it the Xbox killings when the story listed the game system "among other things" seemed a bit much.

Unless I missed the specifics.

Video game slayings? What the hell kind of nonsense is that. They threw it in there just to get peoples attentiods, they do the same thing in the tabloids as well.

The article leaves out the fact the the 3 criminals dressed up in full Halo battle gear and slayed the victims with homemade power swords.

Maybe you should read it a second time. I totaly saw that in the article.

I dont think the x-box had much to do with it. It could have been a half a pack of smokes & these guys still would have done it. It should have been the "eviction murders" because thats what its all about. Thinking "she got me evicted & stole my shit" is what this is about...not an x-box.

You are right who cares why he did it its the act thats important. I don't think anyone will see this as the evils of videogames though. To think this man was addicted to Halo didn't get his fix for a day or two and went nuts isn't going to happen.

I own a resale shop and see shit like this all the time minus the killing part of coruse. Here is what I think happened. He got booted and was pissed about that I am sure. Out on the street pissed off no money and no were to go. The only thing of any value that he could sell for quick cash was the Xbox and games. Possibly the only thing he owned in the world of any value.

He tried to get it back and couldn't so got really really pissed and all hell broke loose. So in my eyes yes it was all about an xbox but not because they guy couldn't live with his halo.

Someone call the state legislature. We need to ban the sale of clothing to people 29 and younger. Clothes don't even have a rating system!!

Could be. I doubt he was a rockefeller. But when I've seen over the top violence in the past its usually just been as a result of the person being a violent basket case rather than from money issues. Example - I had a guy tailgaiting me to a ridiculous degree so I flipped him the bird. He starts yelling and flipping out and waving something at me while we're driving. Next stop light he gets out and runs at me with me a machete. I have zero doubt he would have tried to use it if I hadn't been able to turn right and away before he got there. Should I have been more careful flipping off a random person? Sure. But he was tailgaiting an inch from my fucking bumper and responding to a flip off with a machete is beyond ridiculous. So maybe the xbox guy was poor but this kind of stuff is more about people with rage issues than about money. I think this guy was just your random dirtbag who's a big tough guy and just likes hurting people. Some people get off on it.

I read it and I still dont understand wtf went on. like 37 people got into some arena and battled with chains and baseball bats and garden weasels... the survivor gets an xbox?

I'm shocked that they didn't try to throw drugs into the mix as well. They could have made a commercial with a 25 yearold guy saying "Lastnight I smoked pot with some friends. Then today we broke into my ex-girlfriends apartment and killed her and her friends. See what stupid things you do when you smoke pot?! "
