I was a ghost on this board for the last year or so and spent some time browsing over the different threads that I came across before finally creating a userID and purchasing something from briand1313.

Luckily, that deal went great (outside of UPS telling me my house didn't exist for 2 weeks).

I called the PD down where Steve is from and they said that they usually can't do much in this sort of situation unless I was one of the ones that was scammed.

They did, however, give me a few tips for making sure that you always have a way to enforce the deals youve made immediately without having to get a lawyer involved.

USPS
Send a USPS money order and have them ship via USPS.
They take mail fraud VERY SERIOUSLY. If you pay w/ a USPS money order and they fail to respond after a few weeks or fail to deliver all of the goods, they have large teams that work across state lines that will look into it for you for free and I have heard only good things about the results.

I decided that after having UPS not find my pink and teal house that is flush against the road for two weeks that the Postal Service has no problem delivering to on a daily basis, Im gonna stick with USPS from now on and enjoy the assurance that they know where I live AND that there is something I can do about it if someone tries to pull something shady and not send me what I paid for.

Sheesh, reading this entire topic just grinds my gears. I've gotten ripped about 3 times, so I know what it's like...frustrating as heck. One time the guy that ripped me and about 10 other people lived in Brazil...so yeah. Once other was on eBay and the final time was for a bunch of Magic cards that some jerk stole fromme and about 5 others (tons of money worth). Needless to say, I'm pretty sure they never got caught.

With that being said...Why don't you guys actually do something about it? The 3 or so people that still haven't been compensated...get in AIM on a chat room or something and all call the local PD by him and tell them to actually do something...like pay him a visit, or call him and scare him straight.

Someone like that won't do anything unless they're freaked by the cops. That retarded nerd will probably pee his pants if that happens, which is good for you guys, because then you might get refunded. Just looking at that idiot and what he's done makes me mad. What a psycho...penguin.

Good luck to all you guys.

If this needs to be posted over to the eBay thread, moved elsewhere, or even deleted please do so...

Seller's location is Lafayette, GA

First... $55 for a stated reseal:

http://cgi.ebay.com/ws/eBayISAPI.dll?ViewItem&sspagename=ADME%3AL%3ARTQ%3AUS%3A1&viewitem=&item=270077959265&rd=1

I asked the seller's premise for the listing and got the response via eBay messages:

HELLO, AFTER I FINISH WITH A GAME I HAVE MOVIE GALLERY SEAL IT FOR ME TO PROTECT IT FROM DUST AND DAMAGE.I HOPE THIS HELPS YOU.THANKS

Next I found THIS:

http://cgi.ebay.com/MARIO-PARTY-3-NINTENDO-64-COMPLETE-USED-LIKE-NEW-SEALED_W0QQitemZ8270532594QQihZ020QQcategoryZ62053 QQrdZ1QQcmdZViewItem (http://cgi.ebay.com/STARFOX-64-NEW-FACTORY-SEALED-WILL-THROW-IN-RUMBLE-PACK_W0QQitemZ270076748216QQihZ017QQcategoryZ62053 QQrdZ1QQcmdZViewItem)

and THEN this:

http://cgi.ebay.com/N64-MARIO-PARTY-3-NINTENDO-64-NEW-FACTORY-SEALED-MINT_W0QQitemZ8270526204QQihZ020QQcategoryZ62053QQ rdZ1QQcmdZViewItem

I noticed that BOTH Mario Party 3's are the EXACT same picture, and also that all of his sealed stuff pretty much looks the same.

Most of this seller's stuff is GAMES and VHS's. Some of it is described as being "like new sealed" "sealed like it was brand new", others are stated as being "brand and new factory sealed".

Would someone who's more savvy take a look?

You all want your stuff right? Well I suggest if you all live in the States, you give a call to each other who've been scammed and bring justice to this once and for all. You all were scammed of money your worked for (one way or another). Don't let this guy keep profiting from good people!

Seriously, I hate scammers, and if it ever happend to me, I have the money and power to come after you next day.

Make the call guys/gals. Call his local authorities. Make the police file a police report.

You should have all called his police department long ago. File mail fraud with the USPS as well. This guy is not going to pay you back or give you your stuff and he is going to continue scamming others until the ones he has done it to do something about it.
Kicking this guys a$$ will do no good. I mean look at him, it's obvious he has got his butt kicked many times already. Only sending the guy to jail will help anyone at this point.

dylan0228
03-10-2007, 10:44 AM
If you contact his local authorities, they will redirect you to your own local authorities. I`ve been through this before & believe it or not, it is effective. It may take awhile, but you should definitley give it a shot. I had an officer over here looking at e-mails & pictures for my transaction that I was burned on. I think 2 to 3 months later there was a paypal payment to my account for the exact amount from the seller. So I`d definitley give your local police a call. I`m pretty sure they played a role in returning my money. Make sure you have his paypal address & anything else you can offer. Go get this bastard guys!

Not exactly. I had the same thing happen to me about 5 years ago. Called the PD in the scammers town and was put in touch with a detective. Said even though he only scammed me out of $75, the crime was still a misdemeanor and he'd look into it.

Long story short, I eventually got what I paid for along with a long letter of apology from the scammer. So calling PD in Psycho Penguins city might pay off.

I want to warn everyone that this guy is back and just attempted to scam me. Luckily, I was able to find this thread and the many others on other sites before going through with the transaction.

I am not going to go into details of the attempted scam unless someone really wants to know. Let's just say that he attempted a very suspicious transaction.

He may try to scam others, so buyer beware.

He just gave me this address:

He probably hasn't been banned yet so he could try settle his past disputes here. I just checked his user profile, and indeed his last login was today (7/29). I just can't believe the nerve of that guy. I would be too ashamed to try the same stunt twice, but I guess that is what seperates me from creeps like this.

That'd be my guess as well...but since he obviously has no plans to do so, he should be banned - for good.

Is he still using the same user name on here or is he disguised as someone else? I don`t want to accidentally deal with him!
No, he hasn't been banned here yet, so he's still 'Psycho Penguin' here (he used 'Juan Dixon' at AtariAge, and has used various others at other sites). Even if he is banned here at DP, he's been known to return to sites he's been banned from, so watch out. His real name is Steve McFadden - don't send anything to him.

The thinking before was if he was banned he would have an excuse not to follow through on deals. Since he apparently has no intention of doing so I have called for an admin ban.

Don't wait around for forum leadership to take legal action. All transactions in Buying and Selling should be considered "buyer beware" situations.

Yeah, that's understandable, but anyone who was scammed by him already has his contact info and he has means to communicate with these people without coming here...and if anyone doesn't have it, here it is:

Steve McFadden
938 Alexandria Place
Greenacres, FL 33463

Phone: 561-306-5629 (last known #)
AIM: JuanDixonFor3
MySpace: http://www.myspace.com/captaincharisma03

It's obvious that this guy is simply a bad seed and will just keep scamming people as long as he's allowed here or anywhere else. It's been over a year since he ripped all those people off and over six months since he last showed up here. He's had plenty of time to make good on his past deals and he hasn't done that. At this point, even if he was trying to make legit deals with people (which I doubt), he has no business being here after scamming all those other people. The only thing he should be doing here is posting in this thread as to why he hasn't delivered. He should be banned even if he does make good, because he simply can't be trusted.

I met him on gametz but contacted me through my email. I was new and didnt know any better. Thanks to this site he has given me just cause to report him to the local authorities for selling stolen property. I am also in the process of taking him to court in a civil suit. Also I have emails from him and his own brother stating that he has been scamming people for a while now. The funniest part about this whole ordeal is that WHEN I win my case against him, not only will I get my things back or compensation for them, he will also be paying for all my legal fees says my very good lawyer.

I guess it would be the same as when someone dies with debts. The collectors go to the next of kin and say it's their responsibility to pay, when it in fact isn't. If that's how a suit like this goes, I guess it's down to the family knowing that.

It won't matter as to see this thread, you need to be a DP registered user for 10 days.

Dude is dead and the stuff is long gone. If there was someone that brought litigation against him, it's the courts job to decide what to do (if they hadn't already). Lets let this one fall into the ether people.

Me not feeling bad isn't tied into him ripping off people all over the internet, since I never bought anything from him.

My low amount of sympathy comes not from what he did do but what he didn't do.

For a guy to die at 27 of diabetes complications strongly implies that someone (either Steve or his parents) was extremely irresponsible, lazy, ignorant and lax about doing the things that a diabetic is supposed to do to function day to day and try to live a regular life. Taking insulin, proper diet, exercise, checking blood sugars often, etc.

Obviously I don't know jackshit about the situation, neither does anyone else here, but I've never heard of a diabetic who actually knew how to manage his diabetes dying that young (in their late 20's). Never. Just plain irresponsible about his condition going by the small number of facts we actually have on his passing.

Where do my thoughts come from?

I know a number of people with diabetes, even had a family member who had it. I like to think I have something resembling perspective on it. Not a lot but a little.

Am I wrong here?

For what it's worth, the people who were closest to him online say that he struggled for years with having either no insurance or insurance that wouldn't cover everything he needed and he didn't have the money to properly treat his diabetes out of pocket.

He was also a habitual liar, though, so take his claims however you will.
