This case should be thrown out! There had been warning about the Remote a first place. You got morons did the suing because their property was broken by the remote. The warning was don't throw your remote on instructions for the wii and the games had warnings against throwing wii remote.

only a matte rof time before someone come sin and wants to get their money from a large company. Nintendo did put out numerous warnings about the straps and have recently fixed the issue...so why now?

I agree with you guys - this case is ridiculous. People should read the instructions beforehand and not get too carried away when they used the controller.

No, the straps were not defective. When used properly, the straps do their job just as intended. They hold out for at least 50 lbs. of force, maybe more. Nintendo warns consumers not to throw the remote, and to make sure the wrist strap is fastened. When you throw the goddamn thing through your TV you are either:
a.) throwing the remote
b.) exerting MUCH more than 50lbs of force on it (to break the TV)
c.) not using the wrist strap
d.) all of the above
This lawsuit is no more valid than the McDonald's Hot Coffee incident that started all this frivolous bullshit.

This should be an interesting suit as nintendo stated that the wriststrap is a secondary measure. The first measure being don't let go of the controller. Now nintendo has issued new straps that are thicker, which I thought was a classy thing to do but it may hurt them in the case whereas people will say why did they issue replacements if they were not defective. I see nintendo taking the primary saftey measure route of defense and that the wrist strap was never intended as a primary saftey device and only included as added security. The case was filed in washington which is a very liberal state, and this could be bad for nintendo, though nintendo of america is also based out of redmond, wa where the courts could be more supportive of a local buisness. Someone brought up the point of plaintiffs having to pay court costs if they lose. I'm pretty sure Nintendo will counter sue for costs if they win the case, so that is the case. In cases like this it is very common for the defendant to countersue, to pressure the plaintiff to try and settle out of court, also to recover court costs.

That lady got third degree burns from coffee that was proven to be too hot for human consumption.
What that lawsuit did (particularly with its portrayal in the media) is provide a poster child for "tort reform".

Except that would encourage a defendant to hire the most expensive lawyer possible. The problem is that plaintiff's attorneys don't charge their clients anything (they get paid from the judgment if they win, or the settlement) but defendants' lawyers work on an hourly basis.

They will lose the case nintendo wont have to give any money out they already offer replacement straps and did so as soon as they found out there were stupid morons in the world.

Yeah Sony made those people act like a bunch of thugs. Just like Nintendo made people act like a spazz and throw their controler through their TV. I am glad I can think for myself and not let a video game company do my thinking for me. But then again I can wipe my own butt with no help. Go figure.

I find that to be complete BS. I've played Wii sports many, many, many times with friends and I use a different wrist strap that comes with a controller sleeve my friend bought. It doesn't even have the tightening mechanism and the strap has never broken or the controller flown out of my hand.
These rediculous claims have to be coming from people who are trying to play the Wii like they're Andre Agassi or something. Even if the wrist strap broke, what in the sans hell are they doing that is causing the controller to fly across the room? Can't they just...I don't know? Hold on to it???

I'm convinced all these people were playing Super Monkey Darts. Seriously I thought anyone who could throw a Wii-mote across the room had to be a retarded gorilla, that was until playing the Dart mini game in Super Monkey Ball. You pinch the croller between your thumb and index finger, just like darts and after a few games you really get into it and sometimes the damn controller launches out of your hand. But the strap always saved my butt and I can't imagine I was using enough force to break my tv even if it hadn't.
So I'm still confused, but sometimes the controller does go flying.
If people have that hard of a time holding onto the controler, maybe they should work on their grip. Unless that is they purposly threw it across the room out of anger, like soo many of us have, but instead of towards the ground it was through the TV.

I love class action law suits. The people (essentially the victims) always end up getting like a crappy rebate or a coupon off their next purchase and the prosecuting law firm gets like 4 million dollars.
People keep saying "these people are morons, etc." but to my knowledge there's not a lawsuit pending from an individual, it's just a law firm... Any law firm could create a class action law suit (in fact for something like this that's going to make head lines even if it is going to be dropped it might be smart to get your name out there like this). See people think that this is about dumb americans throwing their controllers around the house, but really it could just be about a firm hopping on a bandwagon to get nation wide publicity, actually scratch that, international publicity.

You personally can actually, but it's not like an automatic thing.
I used to work for a large public company and there was always about 2 dozen lawsuits from regular jo-shoms going on and an additional 1-2 pending class action lawsuits. They always lost and my company always won (it was always the same frivilous crap) and the class action suits never got anywhere, but if they ever did there's such a big payoff so there was always a lawfirm or two willing to take the risk and spend 2 years going to court on and off.
