He listed it. Private auction.
Then he waited for people to ask, since he was looking for trades too.
He told them that he had 3 Navi Saturn.
He asked money by bank transfer.
600 euros to a friend of mine, 1200 plus an Hello Kitty DC to another. I will not name them if it is not necessary.
He asked me 2 sealed Game Boy Pocket Fiorentina LE.
I've sent them to him insured for 600 euros.
After scamming peoples, he closes the auction and starts selling in his language other items.
Then he tells me that he didn't receive the package.
I make the tracking and I discover that he has received the package the 29 december. He doesn't reply to my mails.
I tell him to send me the Saturn or a refund or I'll act against him in every possible way.
At the end, he replies this way:
:)
Now, beware. Seller name: proper75
Real name: adrian przybyla, in-der-au 20, 35606 solms-oberbiel, germany
I've got also his bank account.
I've contacted eBay. I'll fill a complaint at the post office.
Is there something more I can do?
I'd like to take a trip to his town to say hello to him.
Give me new ideas. This has just become my personal crusade. I'm sure I'm not the only one scammed by him.

If your methods of revenge are as thourough as your e-bay searches, this scammer is screwed!
Sorry that happened to you. I have also been scammed, but not for such a large amount of money. I don't have any ideas for you, I'm not sure how the laws are in Italy. Do you have some options in the E.U.? I hope you get your money back, but I'd guess you probably won't. just wanted to express sympathy and say good luck.

Did he reply with a smiley face? If so, thats so provoking, even enough to a serious beating. Even i get so pissed reading this and im not even involved hehe. You can call his bank and tell the story (you find it by checking up on the BIC number at http://www.swift.com/biconline). Dont know if it helps tho, but who knows.

Yes, he replied with a smiling face.
Well, I may try to call the bank, but my transaction didn't involve bank. I should find someone who actually sent him a bank transfer to be scammed like me.
I could call and tell them "your customer is a thief". No, it doesn't work.
I have some pictures of his presumed collection. I may post them.
If anyone finds a GBP Fiorentina LE with sn from 0008 to 0013, it may be stolen.
Really, if I had money and free time, I could have dome a trip to Germany. It would be great to see his face when I ring at his door and ask for my Saturn.

From the "Euroconsumer" website (this is about buying items from a private individual on an auction site, but I think that similar principles will apply to your situation):
Your rights when the seller is a private individual
When you buy something on an internet auction site from a private individual, you have very few rights.
* You can’t complain if the goods are not of satisfactory quality or fit for the purpose you bought them
* You don’t have the right to cancel your order.
You do not have any of the other extra rights you get when you buy on an internet auction site from a business trader without having face-to-face contact.
You do have the right to complain to the seller if your goods don’t match the description they have given on the website. This applies to new and second hand goods. If the goods don’t match the description, you may be entitled to compensation from the seller, but this may involve court action.
When you buy goods from a private seller, you may not be able to make a claim against them if the goods are damaged or lost before delivery. However, if the seller has offered you postal insurance and you have accepted, they will be expected to make a claim on the insurance on your behalf.

P.S. Sorry to hear about your misfortune .. I saw the same auction and was tempted to bid, but when I looked at the feedback and saw that all the other auctions were in Polish - and appear to all be for pirated DVDs, well that kinda put me off.
Don't know if this could be of any help to you or not - came into force in the UK January 2007 ... if it is in place in Italy also, you might be able to find some way to use it:
EC Consumer Protection Co-Operation regulations (http://www.gnn.gov.uk/environment/fullDetail.asp?ReleaseID=253284&NewsAreaID=2&NavigatedFromDepartment=False)

Also, if you know anyone with good German, find out the local police station to where he lives and inform them. Let them go and knock on his door, and then see how many more :) 's you get.
What a scumbag

I think Jajaja has good German? Or possibly hydr0x if he still lurks round here at all. I'm afraid my German is pretty poor.
jajaja
01-08-2007, 07:46 PM
I would think a direct phonecall would be much more efficient. Then you can have a conversation and get a closer "relation". While on e-mail, it will most likely be read, but i doubt it will be put on high priority, unfortunatly.
I think Jajaja has good German? Or possibly hydr0x if he still lurks round here at all. I'm afraid my German is pretty poor.
My german is rather poor when it comes to writing and speaking. I can read better and keep small conversations (like when i buy on Ebay.de), but thats my limits :\ I actually have family in Berlin and my "uncle" is/was a police there. Unfortunatly, i have no contact at all with when. Hydr0x is german afaik, hopefully he can help out better :)
Nicola
01-08-2007, 08:45 PM
It will not be easy to find someone who would call for me, and I don't want to involve my family (they speak german, but can't understand these things)
I may try with english, but I fear that it will cause confusion.
Meanwhile I've added some finds and finished the work of adding infos of ended auctions in the daily finds.
If anyone can help me, I'll be grateful with him and the community. Now it's much more to see some scammer pay. I've been scammed too many times now.

Ok, this is the text I'll send to the police:
Hello, my name is Nicola Ferrarese. I'm writing you from Italy.
I've been defrauded by
adrian przybyla
in-der-au 20
35606 solms-oberbiel
germany
Unluckly I am from Italy and I don't know how to protect myself against him.
This is the whole story:
Adrian Przybyla sells items on eBay (online auction site) with the name proper75
http://search.ebay.it/_W0QQsassZproper75
In december he put for sale this item:
http://cgi.ebay.de/Hitachi-Saturn-HiSaturn-Navi-System-w-Box-More_W0QQitemZ260065743443QQihZ016QQcategoryZ3665Q QssPageNameZWDVWQQrdZ1QQcmdZViewItem
He offered also items for trade.
Me and other two friends contacted him to know what he wanted.
The seller told us that he had 3 of these items for sale.
At the end he asked to one of my friend 600 euros (bank transfer) and 1200 plus another item to the other friend. I can give all the informations about my friends if necessary. They may depose against Adrian.
Luckly my friends didn't pay, but Adrian asked me to trade two items (new Game Boy Pocket Fiorentina limited editions) for one of his Saturn. So I send him the two items the 21/12/2006 with QuickPack Europe, insured for 600 euros, tracking number
EP034487318IT
You may check that he has received the item the 29 december here:
http://www.poste.it/online/dovequando/paccocelereinternazionale.shtml
Then, after being sure to have defrauded me (and I may not be the only one), he closes the original auction and starts selling other items in his original language on eBay.
So he builds up his feedback on ebay, ready to defraud someone once a while.
I start asking him to send me the Saturn, but he hardly replies.
He says that he didn't receive the package. I write him that he has received it.
So I tell him that he must send me the item or a refund or I'll act to take back my money.
He replies with a smiling face. Like this: :)
Now, I have at least 2 people that may tell you the same story. I have his address and his bank account.
I've contacted eBay, but, since I live in Italy, it's hard for me to get some justice.
I've lost 2 items for 600 euros plus shipping.
From the way he has handled the whole story, I presume that it's not the first time he does it and it will not be the last.
I have all the mails he sent to me. My friends have all their mails.
Is there something I can do?
I may contact you by phone, but I can't speak german. I can speak english. If there is someone who can understand me in english, I'll call him immediately.
Please help me.
Thanks,
Nicola Ferrarese
The translator's version:
Hallo, ist mein Name Nicola Ferrarese.
Ich bin Schreiben du aus Italien.
Ich bin vorbei betrogen worden
Adrian Przybyla
In-derau 20
solms-oberbiel
35606 Deutschland
http://www.poste.it/online/dovequando/paccocelereinternazionale.shtml
So: :)
Mir bitte helfen.
Danke, Nicola Ferrarese
If someone may help me to have this text correct, I'll be very happy!!
Thanks!!
It seems i've been scammed like you as well, with approximatively the same method.
I didn't contacted him during the auction, but when he ended it,asking why,and then he made some trade proposals.
I sent him a Panzer Dragoon Orta XBOX complete mint in box system last Friday, by tracked airmail, but by seeing your story, it seems i'm going to be scammed like you.
What can i do for help?
Can a mutual action could help?
How far from you is he?
He's 600km away from Paris..

Great! We are two!
First, you may contact eBay, reporting what happend to you and to me (I've already contacted them) signaling the auction.
Now, let's think what to do!!
Nicola
01-09-2007, 11:42 AM
then, I think we should find out the others who had been scammed.
I'll write on ASSEMbler too.
Adol, give me your mail and I'll send you the mails he sent to me.
To which ebay service would i have to write precisely, since i did NOT deal with him via ebay?

I've sent a complaint trough the original auction. He proposed deals outside ebay, using the auction as a trap.

Adol, before doing anything, try to get as much infos as you can, without giving him any suspect.
Nobody must contact him!
We must investigate as much as we can.
From the pictures he sent to me, he has a very good collection of hardware, with unusual items, from Treamcast to Satellaview.
(I'm going to post it on two forums to get as many attention as possible since I think that we are not the only ones who have been scammed by him)
Nicola

I don't wany to give him the time to throw away or sell all the items stolen. So patience and caution everyone.

Keep in mind that the pictures may not have been of things he actually owned ... just like the ones of the Navi Saturn! A bit of research and some dedicated web-trawling and you could quite easily gather a collection of pics of rare & expensive hardware.

For extra info, the phone number he told me is:

From now on I'll not write his mails publically on the forum unless it's strictly necessary.
He has a good sense of humor. Really!

Nothing! He saw, I think, on this forum or assembler's one, someone who is planning to visit him, then he sent me the mail.
I'm not planning to visit him.

It's sad that someone prefere to have rare game consoles than a correct way of living and a god reputation.
He is really an hardcore collector. Ruin your life to collect.

Ye, i never understood why people would turn themselfs into criminal for relativly small amounts. Sure, 600 euros is much money, but you dont get rich from stealing it, so why ruin your life for amounts like this. Maybe they think they wont be caught by stealing rather small stuff. I hope he gets caught!
You got any reply from the police or something?

I think you should'nt post anything anymore on any board: as a hardcore collector (which it seems he is), he is probably reading all your writings (he just needs to type his own name on google to find those pages)

News:
Adrian asked me to give him the scan of the shipping receipt and my address.
At the moment I have no clue about what he wants to do.
I'll let you know.

Hmm, he's added Paypal now. He also just sold a big load of rare PAL MCD games (amongst other stuff), so perhaps this is actually a genuine guy clearing out a collection. He's got good f/b from recent sales of quite a lot of retro game goodies.

He may have a lot of rare and unique hardware but it's apparent that they are all ill-gotten. That's not a collector since finding these things is part of the joy of owning them. He's just a sad, pathetic loser who has to steal the hard work of others because he's too stupid to actually earn it. Hope the police catch up with him sooner rather than later.
And people wonder why Ebay changed their rules to "paypal only".
I would never send such items or money to someone on this forum, let alone a stranger on ebay!

There is only 1 reason: greed.
eBay owns PayPal. eBay takes a fee when you list, eBay takes a cut when it ends, eBay takes a cut when you receive money from the buyer.
If you seriously thought eBay did that for safety reasons I have a bridge to sell you.
