    Not all Xbox 360 games run in true high-definition. Halo 3 and Perfect Dark Zero run at 640p. Project Gotham Racing 3 runs at 600p.

    They need to add Guitar Hero for the Wii to that lawsuit.

    No, they don't because Activision is actually fixing the audio problem. As I posted in this thread two days ago:

    Activision told IGN it is working on the Wii Guitar Hero III audio problem and it plans to have replacement discs available by early 2008.

    "We recently became aware that some consumers have not been able to enjoy the full audio output in the Nintendo Wii version of Guitar Hero III: Legends of Rock. We are currently working with Nintendo and are planning to issue an improved audio experience in future versions of the game," said Activision spokeswoman Rhy-Ming Poon. "We expect to have re-mastered discs available by early 2008 and we will be offering consumers replacement discs at no cost once they become available. We thank all of our customers for their support and patience."

    Am I able to sue them for not being able to afford an X-Box 360, thus me not being able to play Halo 3 and unable enjoy the 80 pixels that were missing as a result?

    Agreed. The manner and tone in which the article is posted is completely unprofessional. Disregarding the possibity of the frivolity of the lawsuit, the writer obviously is misinformed (as to the McDonald's lawsuit) and clearly does not know the law (as to the Bungie lawsuit) or least to the ability to identify the real legal issue - i.e. false advertising - not whether someone was actually cheated out of 80 pixels.

    I enjoy Joystiq from time to time, but this article makes me wonder why.

    lol theyve been cheated out of more than 80 pixels i guess people have forgotten that monitors have both height and width

    I guess some people has too much time and money on their hand. Heck why not sue every game company for making incomplete game?

    Good idea actually. How many times do we as gamers complain about buggy games, slow frame rate, etc., all due to publishers rushing games out the door. With retailers' return policies not allowing returns on opened games, what other recourse do consumers have?

    Im going to defend the lawsuit merits. Advertise correctly. If it runs at 720p then advertise that, if it doesnt then do not say that your product runs at 720p.


    I remember a few years back all the CRT monitor companies got sued successfully for advertising 17" screens they knew only displayed 15.4" images.

    Plus, maybe as part of the class action lawsuit, some of us might get a partial refund!

    It's the advertisement segment of this lawsuit that has merit and precedence. Suing a game company that's made (in your eyes) an incomplete game would be a waste of time unless the packaging advertised features that weren't on the game, for example, "This game runs at 60fps all the time" or "Two players." To be honest, I'm surprised no one tried a suit against Activision for the Wii mono sound GHIII thing, but it's no surprise that Activision responded as quickly as they did, fearing a lawsuit was eminent.
