Kevtris on a smartphone???

Maybe I'm not familiar enough with software, property rights, and so on, but this strikes me as odd. A homebrew CV game is bundled with a Motorola SmartPhone. Can anyone enlighten me? Is Kevin Horton being ripped off? Or did he sell the rights to his game? Maybe it's not copyrightable? Are there two version of Kevtris?

i think its safe to say they probably arnt the same game...
but the names being the same IS pretty unusual
