    Heh, I was watching that auction. Some eBay lamers don't understand the concept of listing items on eBay. Looks like this guy was just listing it as a back up plan, and probably had the lot advertised in his local paper, and who knows where else? I can't believe he actually sold some of the lot, without even saying anything about it in the auction... I mean he took the time to update the "mistake" on the sealed Kirby's Adventure... what a douche.

    Well , whats the worst here are the circumstances. If I had won this auction for $5,000.00 this would not have happened. He did mention he might end the auction early which was fine I can live with that. That he had this collection listed for sale elsewhere is plausable. I knew upfront before I bid so I can accept that. But here he just put that in there incase the auction didn't sell for enough money.

    I had a similar problem a few years back when I won an auction for an SNES lot with a Super Scope, Avantage, Mouse, and like 50 games for around $100. The seller mailed me within minutes after the auction ended saying that the listing was a mistake, and was supposed to be removed. So I informed him of his binding contract, and he told me that the lot was already sold. ... I could understand why he didn't want to let it go that cheap, but to lie to me about the listing being a "mistake", when I knew he was most likely frantically clicking "refresh" the last ten minutes of it, kinda pissed me off.

    "Let me put it in simple terms

    "1 - Sell the games you're LEGALLY BOUND to sell to the auction winner.

    "2 - Else I'll report this to Ebay & you will no longer be selling here 'cause they'll kick you off for Seller Non-Performance.


    "Your choice. If you're smart- you'll choose 1."
    So let me ask you this. Would you even want to send this guy $1500.00? Now you have to send to someone elses paypal account since his isn't "working right now". Its one thing to be shafted its another to be ripped off. I've given up on getting this stuff. I was pissed off for a day and its over. If ebay suspends him good if not I have to move on and find the next auction.

    I would never have bid. Why bid on an auction that does not accept paypal? Check/money order provides no safety for you.




    But assuming I did bid, YES I'd give him the money if he agrees to sell the goods -'cause I'm protected by paypal & credit cards if he decides to steal the money & not deliver. Plus I'm obligated to pay.

    But if he still refuses- a likely scenario- I'd follow option #2 & report him to Ebay.

    If he accepts, see if there is someone on DP in his area who can act as an intermediary. If he was in my area, I'd do it for you.

    Well at least he can't brag about 100% positive feedback anymore. Also paypal provides you no real protection, those dicks don't care about you. The seller can send you a box of bricks. As long as he has a tracking number that shows he sent you something there is a 95% chance paypal will side with the seller.

    I find these sealed NES lots cause nothing but problems. Remember the large one from Hawaii that had a BIN for 13,000. The winning bidder also didn't get it. I bet some eBayer saw that it went for "low" price and decided to offer the seller and extra couple of hundred for it.

    ebay is a catch-22. According to ebay rules: A seller does not have to complete a transaction but a winning bidder must pay.

    Reason why is either way ebay gets paid, so they dont care. Blasphemy!!
