Default Why is Homebrew Revenge of the Apes (Atari 2600 VCS) a R10?

Atari 2600 VCS - Revenge of the Apes - Rarity

Was there some problems with the copyright? Or were not so many produced? Or is this Rarity wrong, what I think?

I have no problem, when it is a R10, because I own this and I am happy, when it is a R10, my only R10 when I not wrong. But its only a Homebrew Game (Reproduction Hack from a Prototype) and released in 2003. So I can't understand why its a R10 now.
    How many was produced?

Pac-Man from EbiVision is only a 9. And I now, that there was problems with the copyright, and that there were not much produced. But Revenge of the Apes is rarer then Pac-Man? Never hear from any problem there.

Starwing Competition for example is much older and I don't know more then maybe 10 collectors, who own it. And this is too only a R9.

I'm only guessing here, but it's probably one of two things:

    1. Shortly after release, I think I heard that there was a cease and desist involved from 20th Cent. Fox. Ergo, no more (I think) can be legally made. So that ended distribution of that specific title. If you didn't get it, you're not ever gonna get it now.

    2. Or it could just be an error on the rarity guide if that cart is - indeed - still freely available. But a quick scan of AA's store doesn't show it there - unless it's available elsewhere?

One of those two scenarios would be my guess.

Same what I think. But why is Pac-Man from EbiVision then only a 9. I think it must be too a 10. Because only 5 exist stand in the Rarity Guide. And the discribtion from the Rarity Guide say:

R10: Not only is this the centerpiece of a collection, but a ten also means you could be holding a one-of-a-kind (certainly one of no more than a dozen or so) there ...
One of no more than a dozen or so. So Pac-Man (EbiVision) is too a 10 like this discribtion.

AA sold them for US $45.00, when this site is right:
AtariAge Store - Revenge of the Apes

But they are sold out since some month. Don't know how many were made or sold.
