Is this a legal eBay auction??

User states that a CD full of ROMs is also included. But one of ebay's guidelines says ROMs or backups are not allowed.
True, he's not selling the CD.. he's including it in the auction. Is this a workaround?? or still illegal??

It says which game that is original and which games that are on the CD. He says shipping is well over $50 so I guess you will get everything you see on the pictures + that ROM cd hehe :P
Seems pretty stupid to announce to all potential buyers that NES games are available for free via emulation.
