What about test systems that were liquidated publically through the Acclaim bankruptcy sale?
I think those were sold legaly since they werent no longer property of Acclaim due to the bankruptcy
I dont think many really care if an old devkit is being sold on Ebay tho.

As for the pinball, an arcade near my house had one. If I had the space in my house...it would cost 120 euros for me to receive it...
I wrote something up on that a while ago, but basically those are illegal too. The manufacturers (MS, Sony, Nintendo) allow for the licenses to be transfered to other publishers. Microsoft actually came and took back most of the Xbox equipment from the US (they seem to have let it go for the UK auction). Sony and nintendo, on the other hand entered into an agreement with the auction house to let them sell the kits to other developers on the condition that they had to verify their license. It seems some people then broke their licenses and sold the equipment on ebay. Sony and nintendo never gave up the ownership of the devices, they just transfered the lease, thus the acclaim crap on ebay is stolen merchandise. Not that it's really stopped many people...
I'm talking about the public liquidation, not the eBay auctions. Creditors came in and sold it all. Sony and Nintendo could have intervened and recovered their property when this was going on in NY, but it did not happen, and everything was available and sold. Prime example, Assembler and the gazillion Test Systems he bought? What did he have to verify?
My understanding (from the ex-Atari employee that brought 3 of these types of games, Tronic 2 included, to CGE one year) was that the games never went into full production. He had 'final' production samples that look different to the Ebay auction (and full printed boxes), so it is possible that this is an even earlier sample of this game...

Assembler claims to own the licenses from Looking Glass (which i find insanely unlikely). Someone else told me that he just forged the documents needed to get into the auction (seems more likely).
Either way, when it came to the Dev items from Acclaim it wasn't really a "Public Auction". The bidders had to verify that they had valid licenses for the equipment.
Sony and Nintendo only agreed to auction the dev equip. to other licensed developers. From my understanding there were 3 auctions, one for the dev equip. and two public auctions for the furniture etc.
The only way for the items to have fell out of ownership of the manufacturer would be if they had failed to respond after Acclaim filed for bankruptcy liquidation. Anyone who leased them products would have so many days to respond to the auction house or the items would go for public auction. From what I understand, both Sony and Nintendo responded but agreed to let the creditors auction off the dev kits as long as they went to licensed developers. This allowed Sony and Nintendo to retain ownership of the devices. Microsoft, on the other hand said "screw this" and took all of their shit back. Thusly Sony and Nintendo actually retain ownership of all of the dev kits from Acclaim. Assembler has just been fencing stolen goods on ebay, no matter what Assembler would need written permission from Sony or Nintendo to transfer ownership of the devices.
When I was at Tips & Tricks, TheRedEye did an article for us at the time, and was able to bid on dev games from what I recall....
I don't disagree with you about all this "test" stuff, but the items are not taken down from eBay anymore.
