Therefore if someone creates something with the look and feel of something else, but that look is not identical, the wording is not verbatim, and the sounds are not the exact same, then it is not copyright infringing. Furthermore, things such as the intangible feeling of a game are not able to be copyrighted. SEGA could theoretically send a C&D letter, but the developer is not legally required to comply. Furthermore, the music is notably different from Alex Kidd's music.
