If the seller takes the money out of Pay-pal and has none in his bank account then Pay-pal won't give you your money back.
Here's how you win more paypal chargebacks. File through paypal first, of course, but if they cannot secure the funds (i.e. the seller deposited the $$), then call and file a 2nd claim through your credit card. Paypal is then responsible and not the seller. You get your $$ back! Discovercard is very quick at this < 10 days.
Of course, that only works if you used a credit card to send money through PayPal, and NOT your bank account. It's for that reason (chargebacks done wrongly) that many sellers won't take money through PayPal from a credit card. But in this case, it's the only way I'd try it.
