Well I might as well never have bid. Same difference. Anyway he did have perfect feedback with an established account back to 2002. But now that he lied to me and hasn't replied to my last email calling him out I'd never send him any money. The auction is over , I bid and I lost. I can move on, it was a big deal for a day or so but honestly its the norm for NES sellers these days.

I would never have bid. Why bid on an auction that does not accept paypal? Check/money order provides no safety for you.
But assuming I did bid, YES I'd give him the money if he agrees to sell the goods -'cause I'm protected by paypal & credit cards if he decides to steal the money & not deliver. Plus I'm obligated to pay.
But if he still refuses- a likely scenario- I'd follow option #2 & report him to Ebay.

Seller Non-Performance
When a seller lists an item on eBay, and a buyer bids for and wins that item, the seller and buyer have entered into a contract. Both members are expected to honor that contract. In accordance with that contract, the seller may not:
Fail to deliver an item for which payment was accepted.
Significantly misrepresent an item by not meeting the terms and item description outlined in the listing.
Refuse to accept payment for an item at the end of a successful sale.
Refuse to accept a buyer’s PayPal payment using a credit card if the seller included the PayPal logo in the listing which signifies the seller will accept PayPal payments. Sellers are not permitted to state in their listings that PayPal payments made via credit card will not be accepted.
Violations of this policy by a Seller may result in a range of actions, including:
Listing cancellation
Limits on account privileges
Account suspension
Forfeit of eBay fees on cancelled listings
Loss of PowerSeller status
Referral to Law Enforcement
